<br />This Amendment, made this iff!!. day of JU.Ne.. 1999, by and
<br />between the State of Colorado for the use and benefit of the Department of Natural Resources,
<br />Colorado Water Conservation Board, hereinafter referred to as the CWCB or STATE, and the
<br />Board of County Commissioners of Jefferson County, State of Colorado, 100 Jefferson County
<br />Parkway, Golden, Colorado 80419-3550, hereinafter referred to as the CONTRACTOR and/or the
<br />BORROWER.
<br />
<br />Factual Recitals
<br />
<br />A. Authority exists in the law, and funds have been budgeted, appropriated, and othelWise made
<br />available and a sufficient unencumbered balance thereof remains available for payment in
<br />Fund Number 424, Appropriation Code SEV, GBL J855, Contract Encumbrance Number
<br />C153855.
<br />
<br />B. Required approval, clearance, and coordination have been accomplished from and with
<br />appropriate agencies.
<br />
<br />C. The STATE and the CONTRACTOR entered into a contract dated February 17, 1999, Contract
<br />Encumbrance Number C 153855, hereinafter referred to as ORIGINAL CONTRACT, incorporated
<br />herein by reference, wherein the STATE agreed to provide funds in the total amount of
<br />$50,000, and the CONTRACTOR agreed to coordinate the Jefferson County Mountain Ground
<br />Water Resources Study ("STUDY"), which will define the present quantity and quality of the
<br />ground water resources within the Turkey Creek Basin of the mountainous part of Jefferson
<br />County, monitor ground water levels, precipitation and water quality, and provide a method to
<br />simulate effects of current and future development of said ground water resources at a total
<br />estimated cost of $500,000, and to provide the State with full access to Study development,
<br />data, drafts, conclusions and with copies of the interim and final Study reports in accordance
<br />with the terms of the ORIGINAL CONTRACT.

<br />D. The Contractor submitted a request dated February 24, 1999, attached as Appendix A and
<br />incorporated herein, for additional funds which would help complete the Study as well as
<br />generate additional funds through grants it has obtained for this Study that require a matching
<br />cost-share.
<br />
<br />E. At its March 1999 and May 1999 meetings, the CWCB reviewed all projects currently set up to
<br />receive funds from the Severance Tax Trust Fund Operational Account and agreed to expend'
<br />all funds in the account prior to the end of 1999 fiscal year. To meet this deadline, the cost-
<br />share agreement with the Contractor will be amended to provide an amount of up to $15,000
<br />out of the Severance Tax Trust Fund Operational Account.
<br />
<br />F. The STATE and the CONTRACTOR agree to amend this contract to increase the State's cost-
<br />share amount by up to $15,000.
<br />
<br />NOW THEREFORE, it is hereby agreed that

<br />1. Consideration for this Amendment to the ORIGINAL CONTRACT consists of the payments which
<br />shall be made pursuant to this Amendment and ORIGINAL CONTRACT and the promises and
