WHEREAS, authority -exists in the Law and Funds have been budgeted, appropriated and otherwise made
available and a sufficient unencumbered. balance thereof remains available for payment in Fund Number 1001 . .
G/L Account Number 52087, Contract ~ncumbrance Number ; and

WHEREAS, required approval, clearance and 'coordination has been accomplished, from and with appropriate
agencies; and

WHEREAS, '3 pursuant to the provisions of 37-60-119, Colorado
Revised statutes 1973, as amended., the colorado Water Conservation
Board is authorized to construct .certain water projects for the
benefit of the people of the state of Colorado, and

'WHEREAS, the Ci~y of Rifle ~as made applic'ation ~o the Colorado
Water Conservation BOard for the construction of a water project
for the purpose of improving its municipal water supply; and

WHEREAS, the Contractor is a professional engineering firm
within the State of Colorado and has previously done considerable
water-related work for the city of Rifle and various other
municipalities in colorado;

NOW 'THEREFO~E,. it is hereby agreed .that

I. 'The Contractor agrees to prepare a feasibility report
directed to t~e.problem'of improving the municipal water of the
city of Rifle in accordance with a proposal for project feasibility
report prepared by the contractor and approved by the Colorado
Water Conservation Board, received September 8, 1975, . which proposal
is attached hereto as Appendix A 'and made a pa~t of this contract.

2. Thirty'(30) copies of the report called for in this
contract'shall be furnished to the State not later than January 15,
1976, unless such time is extended by mutual agreement of the
parties hereto. .

3. As compensation for the services of the Co~tractor, the
State agrees to pay the contractor the sum of Six Thousand Two
Hundred and Five Dollars ($6,205) in the manner following:

a. sixty percent (60%), to wit~ Three Thousand Seven
Hundred and Twenty-Three Dollars ($3,723) of the total amount .due
in two (2). monthly installments. of One Thousand Eight Hundred sixty
One Dollars and Fifty Cents ($l,86l.50) each, commencing on
November .15,' 1975.
b. The remaining forty percent (40%), to wit, Two
Thousand Four Hundred and Eighty-Two Dollars ($2,482) within thirty
(30) days following receipt and acceptance of the written report
specified in paragraph 2 of this contract.

4. This 'contract is personal in nature and assignment of
performance by the contractor to 'another is prohibited unless prior
approval 'in writing is granted by the state.
