ORDINANCE NUMBER 516

CONCERNING LOANS IN THE AMJUNT OF $1,615,000 FROM THE
STATE OF COLORADO WATER CONSERVATION BOARD (HEREAFTER REFERRED
TO AS THE STATE), AND A LOAN IN THE AMOUNT OF $1, 7B5, 000
FROM THE COLORADO WATER RESOURCES AND POWER DEVELOPMENT
AUTHORITY (HEREAFTER REFERRED TO AS THE AUTHORITY), FOR
THE PURPOSE OF CONSTRUCTING A PIPELINE TO REPLACE
AN EXISTING OPEN DITCH SYSTEM AND IMPROVE TIlE QUANTITY
AND Q\JALITY OF WATER DELIVERBD TO THE JOHNSTOWN FILTRATION
PLANT FOR TIlE TOWN OF JOIINSTOWN, TIllS ORDINANCE, IN
ACCORDANCE WITH 31-15-302 C.R.S., WAS UNANIMOUSLY ADOPTED
BY TIlE BOARD OF TRUSTEES OF TIlE TOWN OF JOIINSTOWN
(HEREAFTER REFERRED TO AS TIlE TOWN), AT A MEETING OF
THE BOARD OF TRUSTEES HELD NOVEMBER 6, 1~95, AT
JOHNSTOWN, COLORADO

BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TO~ OF JOHNSTOWN,
COLORADO I AS FOLLOWS:

A. That the Board of Trustees hereby authori2es the TOWN to
contract for this revenue bond indebtedness of the water system
enterprise, and authorizes the Town Mayor and the To~n Clerk to pay
the revenue indebtedness on behalf of the TOWN, and

B.. Thllt the Board of Trustees hereby authorizes the TOWN to
mak.e and levy assessment {IS} sufficient to payoff these loans
pursu~nt to their terms and to discharge this lawful indebtedness,
and

C. That the aoard of Trustees hereby authorizes the TOWW to
set aside this assessment revenue in a bank account, separate and
apart from other TOWN revenues to assure repayment of this revenue
to the STATE and AUTHORITY, and

D, That the Board of Trvsteee hereby authorizes the TOWN to
sign a security interest in such assessment revenues in favor of
the STATE and AUTHORITY to secure repayment of loans, and

E. That this ordinance shall be irrepealable until the loans
are fully discharged.

F. This ordinance modifies Ordinance Number 497 to che extent
that the terms are in conflict therewith.

The Board of Trustees tinds and declares that an emergency
exists, in that in order to immediately authorize the execution of
the above referenced documents in order to close the transactions
set forth in s~id documents and this ordinance shall take effect
upon publication.
