6.6 Permitting Requirements. St. Vrah:'s :uies, reguiatio:1s and requirements for
the issuance of tap pennits shall be followed by all users of the Tri-P-.rea wastcwate: collection
system. Except for construction tnat is performed by St. Vrai~, no construction on t!1e Tri-Area
wastewater collection system or any connec~ion made thereto shall commence, or be 1r.ade, untii
the plans and specifications and the met.1:>ds of work therefore have been submitted to and

6.7 I~evel of \Vastewater Service. St. Vrain agrees to ope:-ate, maintain, repair anc
replace the Weld County Tn-Area collection system with reasonable and normai care ane! as
necessary to provide efficient, continuous and economical service within Tn-Area. Such
maintenance a.'1d repair shall include, but shal: not :,e limited to. flushing and cleaning of sewer
mains and manholes at least once a year and the performance of point and all other emergency
and routi.'le mRintenance, repairs and reha:,ilitations as necess2l"Y from t~me-to-time on the
Tri-Area wastewater collectio:1 system. St. Vnin shall follow generally accepted procedl.:res and
standards in operating, maintaining, repairing, or replacing the Tri-Area wastewater eoHection
system. By way of explanation and not limitation, Tn-Area shall be responsible for locating the
Tn-Area wastewater collection system sewer mains, including service laterals, to the extent such
location is required by the Excav2.tion Requirement Statute, ~ 9-1.5-1 C.R.S.. et seq., or any
other law, and sha~l serve as the responsible operator in chp.rge with respect to the Tri-..t\rea
wastewater collection system.

SECTION 7
RATES AND CIIARGES

7.1 Rates. For the total wastewater service provided by herel.:nder by St. Vrain,
St. Vrain shall have the right to impose and collect indirectly from the users oftr.e Tn-Area
wastewater collection system sewer services rates as more particularly described on the Scaedule
of Rates and Charges attached hereto as Exhibit B and incorporated herein by this reference. It
is mutually agreed that the rates as so set forth currently provide for tlte payment of a sufficient
amount of revenue to St. Viain will fhlly reimburse St. Vrain for the cost ofthe total wastewater
service provided hereunder. The Schedules of Rates and Charges set fo~i-t on Exhibit B shall
remain in full force and effect until the revenue resulting from the collection of such rates
becomes inadequate to compensate St. Vrain for the wastewater service provided hereu:1der.

7.2 Wastewater Connection Fees. In addition to any other rate or charge provided
for herein, St. Vrain shaH have the right to impose upon each new and modified connection to
the Tn-Area wastewater collection system, such wastewater cOJ'l.nec~ion fee as in effect and
adopted by St. Vrain from tirne-to-time in accordance with the exercise of its lawful authority;
provided said wastewater cor""ection fee shaH be no greater than the wastewater connection fee
imposed by St. Vrain on its in-d:strict res!cents.
