<br />EXHIBIT A <br /> <br />l <br /> <br />. <br />. <br /> <br />INTERCEPTOR CONSTRUCTION <br />AND <br />WASTEWATER SERVICE AGREEMENT <br /> <br />THIS INTERCEPTOR CONSTRUCTION AND W ASTEW ATER SERVICE <br />AGREEMENT ("Agreement") is made and entered into this _ day of ,2007, <br />by and between tbe St. Vrain Sanitation District, a quasi-municipal corporation and political <br />subdivision of the State of Colorado (herein "St. Vrain") and the Weld CO-.lnty Tri-Area <br />Sanitation District, a quasi-mWlicipal corporation and political subdivision of the State of <br />Colorado (herein "Tri-Area"), and collectively somdmes referred to as the "Panies". <br /> <br />RECITALS <br /> <br />WHEREAS. the Parties are Title 32 special districts that are statutorily authorized to <br />provide wastewater services to their respective customers and to enter into intergovernmental <br />agreements pursuant to Section 29-1-203, C.R.S.; and <br /> <br />\VHEREAS, each Party owns, operates and maintains a wastewater treatment plant and <br />collection system; and <br /> <br />WHEREAS, the territorial boundaries and geographic service areas of the Districts are <br />adjacent to one other; and <br /> <br />WHEREAS, by agreements entered into in 1960 and 1971 (hereinafter referred to as <br />collectively the "Dacono Agreeoent"), the Dacono Sanitation District ("Dacono Sanitation") <br />acquired capacity in Tn-Area's wastewater treatment plant equivalent to 2,782 single family <br />residential sewer taps C"SFRE's''); and <br /> <br />WHEREAS, pursuant to the Dacono Agreement, Tri-Area currently receives, treats and <br />disposes of wastewater generated by or arising from 1,700 SFRE's located within that portion of <br />Dacono Sanitation that is in and adjacent to the old town area of the Town ofDacono; and <br /> <br />WHEREAS, as a result of growth occurring within Tn-Area's service area and <br />increasingly stringent effluent discharge standards. certain capital improvements to Tn-Area's <br />wastewater treatmeat plant will be required in order to :neet federal and state discharge PerJI'ljt <br />standards; and <br /> <br />WHEREAS, by way of further explanation, Tri-Area's wastewater treatment plant is <br />currently being operated under a Compliance Order on Consent ("Consent Order") issued by the <br />CoJorado Department of Public Health a.'1d Environment acting through its Water Quality <br />Control Division.
