<br />THIS CONTRACT, made this Wday of December 2000, by and between the State
<br />of Colorado for the use and benefit of the Department of Natural Resources, Colorado Water
<br />Conservation Soard, hereinafter referred to as the CWCS and/or STATE, and the EI Paso
<br />County Water Authority, 27 E, Vermijo, Colorado Springs, Colorado 80903, hereinafter referred
<br />to as the CONTRACTOR.

<br />FACTUAL RECITALS
<br />
<br />A. Authority exists in the law, and funds have been budgeted, appropriated and otherwise
<br />made available and a sufficient unencumbered balance thereof remains available for
<br />payment in Fund Number 424 Organization YYYY, Appropriation ELP, GBL ELPO,
<br />Program WTRC, Object Code 5120, Reporting Category 0032, Contract Encumbrance
<br />Number C150032,
<br />
<br />8, Required approval, clearance, and coordination have been accomplished from and with
<br />appropriate agencies,
<br />
<br />C, Section 37-60-121 (1)(b)(IV), C,R.S" authorizes the STATE to make grants from the CWCS
<br />Construction Fund with specific authorization from the General Assembly,
<br />
<br />D, The CONTRACTOR is comprised of several water providers that provide water outside of the
<br />service area of Colorado Springs in EI Paso County, Colorado,
<br />
<br />E, The CONTRACTOR has adopted a five-year program of technical studies aimed at the
<br />development of a long range countywide Water Master Plan ("PLAN") to identify the current
<br />and future development of water resources, systems and facilities for the benefit of the
<br />residents of EI Paso County ("County"),
<br />
<br />F, At its November 1999 meeting, the CWCS approved a grant of up to $200,000 from the
<br />CWCS Construction Fund to the CONTRACTOR to support the preparation of the PLAN, with
<br />funds to be disbursed to the CONTRACTOR on a 50% cost share basis until the PLAN is
<br />completed or $200,000 has been disbursed,
<br />
<br />G, Pursuant to H,S, 00-1419, Section 12, the General Assembly authorized the CWCS to
<br />allocate $200,000 to the CONTRACTOR to prepare the PLAN, and specified that the
<br />CONTRACTOR, EI Paso County, and the CWCS would develop the scope of work for the
<br />PLAN,
<br />
<br />H, The CONTRACTOR and the County shall direct the preparation of the PLAN in cooperation
<br />with the Colorado Water Conservation Board,
<br />
<br />I. The CONTRACTOR and the County have selected John C, Halepaska and Associates, Inc,
<br />and Knight Piesold and Co, ("CONSULTANT") to prepare the PLAN and have approved a
<br />scope of services for the PLAN tasks prepared by the CONSULTANT,
<br />
<br />NOW THEREFORE, in consideration of the mutual and dependent covenants contained
<br />
