WHgREAS, pursuant to the provisions of section 37-60-119,
Colorado Revised statutes; as amended, the State is authorized
to construct certain water'projects for the benefit of the
peopl'e of the State of Colorado; and

WHEREAS. the Ish Reservoir has made application to the
State for the'improvement of its existing facility. such
improvement of. the facility is hereinafter sometimes referred
to as the project; and

WHEREAS. the Contractor is a reservoir company within the.
State of Colorado;

NOW THEREFORE, it is hereby agreed that:

1. The Contractor shall have a feasibility report prepared
and directed to the problem of improving the facilities of the
Ish Reservoir. located in Larimer County. Colorado. in
accordance with a proposal for a project feasibility repo=t
prepared by the conSUlting engineering firm of Rocky Mountain
Consultants. Inc. (the Consultant). and approved by the State.
received September 25. 1987. which proposal is attached hereto
as EXhibit A and made a part of t.his contract...

2, Ten (10) copies of the final report called for in this
contract shall be furnished to the State not later than
sixty (60) days after the date of this contract. unless such
time is extended by mutual agreement of the parties hereto in
writing.

3. As compensation for the services of the Contractor. the
State shall pay to the Contractor the sum of Three Thousand
Dollars ($3.000) in the manner following:

a, Sixty percent (60\). to wit. gighteen Hundred Dollars
($1,600) of the total amount due in two (2) monthly
installments of Nine Hundred Dollars ($900) each.
commencing twenty (20) days after the ~ate of this contract.

b. The remaining forty percent (40\), to wit, Twelve
Hundred Dollars ($1.200) within forty (40) days following
receipt and acceptance of the written_report specified in
paragraph 2. of this contract.

4. The total~cost of services to be rendered for the
Contractor by the Consultant is Six Thousand Dollars ($6.000)
and the Contractor shall pay the sum of Three Thousand Dollars
($3.000) as agreed to by letter dated September 24. 1967. which
is hereby attached and made a part of this contract as Exhibit
B; and in no event shall this payment be the liability of the
State of Colorado.
