<br />SPDSS Phase 2 Ground Water Comnonent
<br />THIS AMENDMENT, made this � day of ���''�y`�� 20l�� by and between the State of Colorado for the use
<br />and benefit of the Department of Natural Resources, Colorado Water Conservation Board hereinafter referred to as the
<br />State, and Camp Dresser & McKee Inc., 1331 17"' Street, Denver, CO 80202, hereinafter referred to as the contractor,
<br />FACTUAL RECITALS
<br />Authority exists in the Law and Funds have been budgeted, appropriated, and otherwise made available and a sufficient
<br />unencumbered balance thereof remains available for payment; and
<br />Required approval, clearance, and coordination has been accomplished from and with appropriate agencies; and
<br />The parties entered into a contract dated November 13, 2002, Phase 1 of the SPDSS ground water component for
<br />$513,333. The original contract recognized that additional work tasks and funding may be required to perform subsequent
<br />tasks after the field study work plan task was completed. Amendment #1, for $28,129, addressed the subsequent work
<br />tasks and also reflected new language for changes related to the drilling methodology.
<br />The intent of Amendment #2 is to increase the compensation of Tasks 33, 35, 36, 37, 39, 40, 42, 43, 44, 44, 50 and 51,
<br />outlined in Exhibit A, which cover the costs of Phase 2 of the SPDSS ground water component.
<br />NOW THEREFORE, it is hereby agreed that
<br />1. Consideration for this amendment to the original contract, (Contract Routing Number), 03 PDA 00024, (Contract
<br />Encumbrance Number, C153953, dated November 13, 2002, consists of the payments which shall be made pursuant
<br />to this amendment and the promises and agreements herein set forth.
<br />2. It is expressly agreed by the parties that this amendment is supplemental to the original Contract Routing Number 03
<br />PDA 00024 (Contract Encumbrance Number, C153953) which is attached as Exhibit #1, dated November 13, 2003,
<br />referred to as the "original contract," as amended on November 18, 2003, Contract Routing Number 04 PDA 00020,
<br />which is attached as exhibit #2, by this reference, incorporated, and made a part hereof, and all terms, conditions, and
<br />provisions thereof, unless specifically modified herein, are to apply to this amendment as though they were expressly
<br />rewritten, incorporated, and included herein.
<br />3. It is agreed the original contract is and shall be modified, altered, and changed in the following respects only:
<br />a. Compensation increased for Tasks 33, 35, 36, 37, 39, 40, 42, 43, 44, 44, 50 and 51, as set forth in the
<br />Amendment #2 Scope of Work attached as Exhibit A and incorporated herein, by $833,933 for an overall total
<br />cost of $1,375,395.
<br />b. The time to complete the project shall be extended to Apri130, 2005.
<br />4. The effective date of this amendment is , 2003, or upon approval of the State Controller, whichever is
<br />later.
