WHEREAS. authority exists in the Law and Funds have been budgeted. appropriated and otherwise made
availllble and a sufficient unencumbered balance thereof remains available for payment in Fund ~umher 4008

WHEREAS. re4uircd appruv:d. c1earam:e and coordinaliun has been accomplished (rom and wilh appropriale

WHEREAS. pursuant to the provisions of 37;60-119 and
37-60-120. Colorado Revised Statutes. the State is authorized
to loan money for the construction of water p!ojects for the
benefit of the people of the State provided that the Contractor
.assures repayment of that money; and

WHEREAS. the Contractor is a water company in the State of
Colorado and it wished to improve the facilities of the Bauer
No.1 Reservoir Dam. hereinafter sometimes called the project.
for the benefit of the shareholders of the water company in
Montezuma County. Colorado. at an estimated cost of Two Hundred
Thousand Dollars ($200,000); and

WHEREAS. the State and the Contractor entered into a
contract dated June 28. 1989. Contract Encumbrance Number
C-153564, Routing Number 89600 (hereinafter tbe 'Original
Contract"): and

WHEREAS. the Original Contract authorized the State to loan
$100.000 to the Contractor for the rehabilitation of the Bauer
No. 1 Reservoir Dam: and

WHEREAS. construction of the project has been completed to
the satisfaction of the State and the Contractor; and

WHEREAS, the State actually only advanced a total of
Ninety-Two Thousand Eight Hundred Fifty-One Dol1ars and
Twenty-Two Cents ($92,851.22) to tbe Contractor for the
construction of this project and preparation of feasibility
report: and

WHEREAS. the Contractor obtained unexpected supplemental
grant funds from the U.S. Department of Agriculture, Soil
Conservation Service. to pay part of the cost for the
construction of this project after the State had already
advanced its Ninety;'l'wo 'l'housand Eight Hundred Fifty-One
Dollars and Twenty-Two Cents ($92,851.22); and

WHEREAS. as a result of receiving the unexpected grant
funds from the Soil Conservation Service. the Contractor did
not need all of the Ninety-Two Thousand Eight Hundred Fifty-One
Dollars and Twenty-Two Cents ($92.851.22) which the State bad
loaned for the project; and

WHEREAS. the Contractor sent a check for Twelve Thousand
Dollar$ ($12,000) to the State for the purpose of reducing the
loan amount on the project.
