<br />binding against the BORROWER if entered into by the CWCB, <br /> <br />5. The BORROWER agrees that it shall provide the following documents, all of which shall <br />set forth the loan amount of $2,443,000: <br /> <br />a. Promissory Note, attached as Attachment A and incorporated herein, which shall <br />replace and supersede the Promissory Note in the amount of $2,081,000 dated <br />March 1, 2002, attached to the ORIGINAL CONTRACT as Appendix 2. <br /> <br />b. Ordinance, attached hereto as Attachmen't B and incorporated herein, adopted by <br />the BORROWER'S governing body, irrepealable for the term of this loan, authorizing <br />the BORROWER to enter into this contract amendment to borrow the additional <br />$362.000 and to make and levy assessments sufficient to pay the annual loan <br />payments. <br /> <br />c. Amended Security Agreement, attached hereto as Attachment C and incorporated <br />herein, which shall supplement and operate in conjunction with the Security <br />Agreement dated March 1, 2002, attached to the ORIGINAL CONTRACT as Appendix 4. <br /> <br />6. The parties agree that the ORIGINAL CONTRACT, is and shall be modified, altered, and <br />changed in the following respects only: <br /> <br />a, Project Summary, Section 3 - Board Approval and Legislative Authorization, shall be <br />revised by the addition of the following: <br /> <br />At its July 2001 meeting, the CWCS approved increasing this loan by $362,000 for a <br />total loan amount of $2,443,000. The terms for the additional loan amount are an <br />interest rate of 5.50% per annum and a repayment term of 30 years, The CWC8 <br />has authority to increase the loan amount pursuant to S801-157 Section (2)(2). <br /> <br />7. Except for the SPECIAL PROVISIONS, in the event of any conflict, inconsistency, variance, <br />or contradiction between the provisions of this Amendment and any of the provisions of <br />the ORIGINAL CONTRACT, the provisions of this Amendment shall in all respects <br />supersede, govern, and control. The SPECIAL PROVISIONS shall always be controlling <br />over other provisions in the contract or amendments. The representations in the <br />SPECIAL PROVISIONS concerning the absence of bribery or corrupt influences and <br />personal interest of STATE employees are presently reaffirmed. <br /> <br /> <br />Page 3 of 4 <br />
