. Introduction (Need for the Project) . The John Peroulis & Sons Partnership (JPSP) located in Moffat County, Colorado operates the Martin Cull Reservoir for storage of irrigation water for use on 450 acres of land owned by the JPSP. The reservoir is located approximately 28 miles north-northeast of Craig, Colorado and is filled by an unnamed tributary to Founnile Creek, which is a tributary to the Little Snake River, which in turn is a tributary to the Yampa River. The dam for the reservoir was constructed in the 1950's and is an Intennediate Class 3 structure, which is approximately 53 feet high, 450 feet in length and impounds a reservoir of 250 acre-feet, A vicinity map showing the approximate location ofthe project site is shown in Appendix A, In the summer of 2000, a slide/failure occurred along the upstream face of the dam embankment, as water was being released for irrigation, The slide was approximately 250 feet in length with a maximum vertical displacement on the order of 6 feet. The toe of the slide is situated at the toe of the upstream face of the embankment. The failed materials slid into the inlet structure for the outlet pipe, causing the concrete inlet structure to separate from the outlet pipe and gate and rendering it inoperable, The dam was inspected by the State Engineer's Office on October 4, 2000 and a zero storage restriction was imposed on the reservoir by a letter dated October 25, 2000, The reservoir has remained empty since the failure occurred, The JPSP needs to rehabilitate/repair the Martin Cui! Dam so that it Can be safely placed back in service as soon as possible, JPSP needs to complete the repairs to the Martin Cull Dam by this fall so it can store water next spring to provide water for irrigation in the summer of2003, Project Sponsor . The JPSP is a General Partnership registered in the State of Colorado consisting of 6 members of the Peroulis family, The JPSP was fonned for the purpose of engaging in general investment and management activities invoiving ranching and fanning, The JPSP has the power to take on debt, to pledge collateral for that debt, and is not subject to TABOR. Water Rights The JPSP owns water storage rights in the Martin Cull Reservoir in the amount of250 acre-feet. The State Engineer's Records indicate that the reservoir was used to capacity during the period] 997 through 2000, The reservoir was not in use in 200 I due to the failure and storage restriction put on the reservoir by the State of Colorado, .
