'District water' shall mean all water that accrues to :he use of the District or its allottees <br />by reason of the Colorado-Big Thompson Reclamation Project. <br /> <br />f. 'Entity" shall mean any quasi-municipal corporation, limited liability company, municipal <br />corporation, public corporation, joint venture, partnerShip, person, mutual ditch company, <br />water users' association or private cotporation. <br /> <br />g. "Fiscal Year" shall mean the fiscal year of the SWSP :nterprise. currently, the fiscal year <br />of the SWSP Enterprise begins on october 1 and ends on september 30 of the following calendar <br />year. However, the SWSP Enterprise may change the riscal Year during the ten of this <br />Contract. <br /> <br />h. 'GPO' shall mean gallons of water per day measured over a 24-hour period beginning at 12:00 <br />a.~. and teninating at 12:00 a.m. on the next day. <br /> <br />1. 'Initial Participants' shall mean th~ Allottee and any other Entity with an enforceable <br />contract for an allocation of capacity in the Pipeline executed on or befor~ september 1, 1995. <br />Attached hereto as Schedule A and intorporated herein by this reference is a list of all <br />Initial participants in the Pipeline, their respective initial allotted capacities in GPO, <br />their respective initial points of clelivery from the Pipeline and th~ minimUII hydraulic <br />elevation at such delivery points. <br /> <br />j. 'Participant' shall mean the Allottee and any other Entity with an enforceable contract for <br />an allocation of capacity in the Pipeline .hich Entities may change from time to time as <br />petmitted hereunder. <br /> <br />k. 'Pipeline" shall mean the Fort Luptonjaudson Pipeline that has been designed, bid and pursuant <br />to the terms of this Contract, constructed by the S.SP Enterprise, as generally descrihed <br />on Exhibit 1 attached hereto and in~orporated herein by this reference. The Pipeline is <br />specifically described in the Specifications entitled Southern Water Supply Project, Fort <br />LUpton/Hudson and LouisvillejSuperior Pipelines, dated Hay 1995, and the Drawings entitled <br />Southern water supply Project, Fort LUpton/Hudson Pipeline, dated Hay 1995, both prepared by <br />Black & Veatch, including all change orders thereto ~rocessed pursuant to the construction <br />cOntracts, such Drawings and Specifications being incorporated herein by this reference. <br /> <br />1. 'Segment" shall mean an individual segment of the Pipeline for .hich the design capacity is <br />constant. The Pipeline is divided into two segments. ,ttached hereto and incorporated herein <br />by this reference as Schedule B is a description of each segment, including a description of <br />the point of beginning and point of termination of each segment and a cOst allocation within <br />each segment and the allotted capacity in cubic feet per second in each segment for each <br />Initial Participant. <br /> <br />m. 'Subdistrict" shall mean the Hunicipal Subdistric:, Northern Colorado Water Conservancy <br />District, a political subdivision of the State of Colorado, and a body corporate with all the <br />powers of a public or municipal corporation, organized and existing by virtue of Title 37, <br />Article 45, Colorado Revised Statutes, as amended. <br /> <br />2 <br />
