<br />~;':;' <br />, .., <br /> <br />ORDINANCE 429 <br />FLOOD CONTROL <br />PUBLIC WORKS PROJECT <br /> <br />2 <br /> <br />whether the water service supplier is the municipal government of <br />Erie or other. The amount of the monthly fee will be S2.00. <br /> <br />The fee will be co1lected using the Town's water billing mechanism, <br />collected as a separate fee but at the same time the water charges <br />are collected. <br /> <br />FOr assessments where the municipal government of Erie is not the <br />water service supplier one of ~he following methods of fee collection <br />will prevail I <br /> <br />1. The annual fee will be billed and collected once each year, <br />or <br /> <br />2. The fee will be collected through the cooperation of the <br />water supplier. <br /> <br />The Town of Erie presently ha~ over 525 water taps. This fee shall <br />generate a minimum of S1050.00 per month of $13,100.00 annually. <br />This amount is in excess of the annual payment to ewcs of Sll,463.00 <br /> <br />These fees shall only be used tor annual payments. In the event this <br />Public Wo~ks fee does not yiel~ a minimum of $11,463.00 annually, the <br />Town of Erie will implement a revenue source which is authorized to <br />a statutory town. <br /> <br />SECTION 3. <br /> <br />DATE OF EFFECTIVENESS <br /> <br />This Ordinance is necessary for the health, safety, and welfare of <br />the Town of Erie and shall become effective immediately after passage <br />by the Soard of Trustees of the Town of Erie. <br /> <br />The fund shall be set up immediately and funds formerly collected in <br />the Drainage fund will be transferred into this Public Works fund. <br />Immediately after transfer the Drainage fund shall cease to exist. <br /> <br />At a minimum, fees, fund, and this Ordinance will oontinue to exist <br />until repayment to ewcs has been satisfied. <br /> <br />SECTION 4. <br /> <br />RECOVERY ACTIONS - ADMINISTRATIVE AND CIVIL <br /> <br />The Town shall have the right to recover all sums due the Town under <br />the terms of this Ordinance from property owners in the Town of Erie <br />and shall seek such recovery by lien(s) against property, and or <br />judgement and execution thereon through civil action in any court ot <br />competent jurisdiction. Failure to pay fee with monthly water bill <br />will subject customers to same water bill delinquency cha~ges <br />mandated by Ordinance 281, Section 12.1, "Delinquency. or amendment <br />thereof. <br />
