<br />current certificates of all such insurance have been <br />obtained by the Contractor and filed with the state, <br /> <br />9. Permit periodic inspection of construction by authorized <br />representatives of the state for the reasons set forth in <br />Paragraph A-12 during and after construction and prepare an <br />"Operations and Maintenance Manual" for the completed project with <br />annual inspection thereafter on or before April 1st. <br /> <br />10. without expense to the state, manage, operate, and <br />maintain the,project continuously in an efficient and economical <br />manner, and assume all legal liability for such management, <br />operation, and maintenance. The Contractor agrees to indemnify <br />and hold the state harmless from any liability incurred by the <br />state as a result of the state's interest in the project <br />facilities. The Contractor shall maintain comprehensive general <br />liability insurance covering the management, operation, and <br />maintenance of the project from the time it accepts the <br />constructed project as substantially completed until it completes <br />repayment to the state, in at least the following amounts: <br /> <br />a. For any injury to one person in any single occurrence, <br />the sum of One Hundred Fifty Thousand Dollars ($150,000). <br /> <br />b. For any injury to two or more persons in any single <br />occurrence, the sum of Four Hundred Thousand Dollars <br />($400,000). <br /> <br />c. For any damage to property, the sum of Four Hundred <br />Thousand Dollars ($400,000) for'each occurrence. <br />.'"-- <br />Said general liability insurance shall name the State as a <br />~co-i~9~ A copy of a certificate of said liability <br />~~urance must be filed with the State prior to the start <br />of the operation of the project system. Such certificate <br />shall be incorporated herein as part of this contract. <br /> <br />11. Pursuant to State statute, adjust its service charges and <br />levy assessments from time to time as necessary, upon written <br />notice from the state, to provide sufficient funds for adequate <br />operation and maintenance, emergency repair services, obsolescence <br />reserves, and debt reserves, and to assure repayment of the <br />project loan to the State as provided herein. <br /> <br />12. Provide the State with such periodic reports as the State <br />may require and permit periodic inspections of its operations and <br />provide an account of the IIpublic Works Fund" balance as requested <br />by a designated representative of the State. All inspections <br />shall be for the purpose of ascertaining the Contractor's <br />compliance with this agreement only and shall not be relied upon <br />as a technical engineering, safety, feasibility, or plan <br />compliance inspection. <br /> <br />13. Repay to the State the total principal sum of Three <br />Hundred Thirteen Thousand Five Hundred Thirty Dollars ($313.530), <br />which includes the project loan amount together with interest at <br />the rate of two percent (2%) per annum, said repayment to be made <br />in constant annual installments of Eleven Thousand Four Hundred <br />Sixty-Three Dollars ($11,463) each, for forty (40) years, for a <br />total charge of Four Hundred Fifty-Eight Thousand Five Hundred <br />Twenty Dollars ($458,520) as shown in Exhibit D, attached hereto <br />and incorporated by reference herein, which first installment <br />shall be due and payable on the first day of the month next <br />succeeding the month in which the State determines that the <br />project has been substantially completed, and yearly thereafter <br />until the entire principal sum shall have been paid. said <br />installment payments shall be made payable to the Colorado Water <br />Conse.vation Board, payable at the offices of said Board in <br />Denver, Colorado. <br /> <br />Page 1 Df ~ Pages <br /> <br />. .
