<br />.-- . ot;;J..::;. <br /> <br />.. ; <br />.. ~ <br />~''j" <br /> <br />., <br /> <br />. <br /> <br />ORDIN.l\.NCE 445 <br /> <br />AND ORDINANCE AMENDING ORDINANCE 417 AND PROVIDING <br />FOR A LIMITATION ON COLL~CTION OF FEES <br /> <br />"") <br />'",,- <br /> <br />WHEREAS, it has been previously determine~ by the Board of Trustees that <br />proper drainage and flood control is necessary for the protection of the <br />health, safety, and welfare of its citizens, and <br />WHEREAS, the Board of Trustees finds that adequate drainage control will <br />protect property in the Town of Erie; and <br />WHEREAS, the Board of Trustees finds that an opportunity exists to complete <br />a flood control project using now available grants and low interest loans <br />at minimal cost to its citizens: and <br />WHEREAS, it has been determined that a flood control project in Erie may <br />save: its citizens insurance costs, promote economic development in the <br />business sector, and promote residential building: and <br />WHEaEAS, a net savings to Erie citizens should exceed the cost of <br />completing the flood control project; and <br />WHEREAS, the project costs relating to the Coal Creek Flood Pl~in Project <br />are found to be greater than previously anticipated: and <br />WHEREAS, the Board of Trustees finds it necessary for the public health and <br />safety to increase the fee as set forth in Section 2 of Ordinance 417 in <br />order to fund an increase in the loan amount requested from the Colorado <br />Water Conservation Board. <br />NOW THEREFORE BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF ERIE, <br />COLORADO, <br />That the first paragraph of Section 2 of Ordinance 417 is hereby amended to <br />read as follows: <br />SECTION 1. FUNDS <br />A monthly fee will hereby be assessed to all existing <br />and future Erie residential households and businesses <br />having a water tap, regardless whether water service <br />supplier is Erie or others.
