<br />"-~.... <br /> <br />-' <br /> <br />DEPARTMENT l 'Y NAME <br />Water Conservatic.l,' Board <br /> <br />DEPARTMENT DR AGENCY NUMBER <br />PDA <br /> <br />ROUT I NG NUMBER <br /> <br /> <br />Total Contract Amount: $313,53 0 ~ original) <br />. $498,512w/amendment <br /> <br />AMENDMENT #1 TO PROJECT CONTRACT <br /> <br />THIS CONTRACT, made this do day of 1994, by <br />and between the State of Colorado for the us and benefit of the <br />DEPARTMENT OF NATURAL RESOURCES - COLORADO WAT CONSERVATION BOARD <br />hereinafter referred to as the State, and The Town of Erie, P.O. <br />Box 100, Erie, CO 80516, hereinafter referred to as the <br />Contractor or Borrower. <br /> <br /> <br />WHEREAS, authority exists in the Law and Funds have been <br />budgeted, appropriated and otherwise made available and a <br />sufficient unencumbered balance thereof remains available for <br />payment in Fund Number 424, Organization YYYY, Appropriation 357, <br />Program WTRC, Object Code 5120, Contract Encumbrance Number <br />NC1536031r and <br />- I <br />~. . <br />WHEREAS, required approval, clearance and coordination have <br />been accomplished from and with appropriate agencies; and <br /> <br />WHEREAS, pursuant to the provisions of 37-60-119, Colorado <br />Revised Statutes, the State is authorized to loan and grant money <br />for the construction of water projects for the benefit of the <br />people of the State of Colorado so long as the State is provided <br />with security which assures the repayment of said loan; and <br /> <br />WHEREAS, the Town of Erie is a statutory town in Weld County <br />and Boulder County in the State of Colorado; and <br /> <br />WHEREAS, the Borrower desires to participate in the <br />construction of the Project, in part through financing from the <br />State; and <br /> <br />WHEREAS, the State and the Borrower entered into a contract <br />dated January 21, 1992, Contract Encumbrance Number C-153603 <br />(hereinafter called the "Original Contract"); and <br /> <br />WHEREAS, one of the conditions in the Original Contract was <br />that the project be completed within two (2) years of the date of <br />execution for said contract; and <br /> <br />WHEREAS, circumstances beyond the control of the Borrower <br />
