Unit 77-77-777, <br />WUEREAS, rC4uired approval. clearancc and coordination has been accomplished from and with appropriate <br />a!!.cllcie~; and <br /> <br />Amendment to and Assignment of Contract <br /> <br />This Amendment to and Assignment of Contract made this <br />1st day of August, 1985. by and between the State of Colorado, for <br />the use and benefit of the Department of Natural Resources, <br />Colorado Water Conservation Board (hereinafter referred to as the <br />~tate), the Paradox Valley Canal and Reservoir Company (Assignor) <br />and the Paradox Valley Water Conservancy District (Assignee). <br /> <br />WHEREAS, the State and the Paradox Valley Canal and Reservoir <br />Company entered into a contract for the improvement of the Buckeye <br />Reservoir on August 15, 1981 (a copy of which contract is attached <br />and incorporated by reference herein as Exhibit A and is herein- <br />after referred to as the original contract); and <br /> <br />( <br /> <br />WHEREAS, the State and the Paradox Valley Canal and Reservoir <br />Company amended the original contract on August 15, 1983, to aliow <br />for an extension of time to complete improvements to the Buckeye <br />Reservoir (a copy of which amendment is attached and incorporated <br />by reference herein as Exhibit B); and <br /> <br />WHEREAS, paragraph D. of the original contract provided that <br />the contract was assignable by the Paradox Valley Canal and <br />Rea:ervoir COlnlJany only_upon written approval of the State; and <br /> <br />WtiE-REAS, the Paradox Valley Canal anu Reservoir Company <br />wishes to assign the original contract as amended to the Paradox <br />Valley Water Conservancy District; and <br /> <br />WHEREAS, the Paradox Valley Water Conservancy District agrees <br />to assume all the responsibilities, duties, and obligations of the <br />Paradox Valley Canal and Reservoir Company under the original <br />contract as amended; and <br /> <br />WHEREAS, the State agrees to the assignment of the original <br />contract as amended; <br /> <br />NOW THEREFORE, it is hereby agreed that: <br /> <br />1.
