<br /> Grantor and Beneficiary have agreed to amend the Original Deed of Trust and its
<br /> amendment to reflect the additional loan contracts and promissory notes that are secured by
<br /> the instrument.
<br /> NOW THEREFORE, the CWCB and Grantor agree that:
<br /> 1. The second full paragraph of the Original Deed of Trust, as previously amended, is hereby
<br /> amended to add the following:
<br /> The Grantor has also executed a Promissory Note dated September 13, 2011 to secure the
<br /> repayment of the indebtedness evidenced by Contract No. C153333, dated September 15,
<br /> 1980, as amended on September 13, 2011 for the total principal sum of $350,000, to be
<br /> repaid to the State of Colorado for the use and benefit of the Department of Natural
<br /> Resources, Colorado Water Conservation Board ("CWCB") the beneficiary herein, whose
<br /> address is 1313 Sherman Street, Room 721, Denver, CO 80203, payable in 40 annual
<br /> installments, in accordance with said Promissory Note, or until the loan is paid in full.
<br /> The Grantor has also executed a Promissory Note dated September 13, 2011 to secure the
<br /> repayment of the indebtedness evidenced by Contract No. C153355, dated September 1,
<br /> 1981, as amended on September 13, 2011 for the total principal sum of $280,000, to be
<br /> repaid to the State of Colorado for the use and benefit of the Department of Natural
<br /> Resources, Colorado Water Conservation Board ("CWCB") the beneficiary herein, whose
<br /> address is 1313 Sherman Street, Room 721, Denver, CO 80203, payable in 40 annual
<br /> installments, in accordance with said Promissory Note, or until the loan is paid in full.
<br /> The Grantor has also executed a Promissory Note dated September 13, 2011 to secure the
<br /> repayment of the indebtedness evidenced by Contract No. C153320, dated December 15,
<br /> 1979, as amended on September 13, 2011 for the total principal sum of $1,500,000, to be
<br /> repaid to the State of Colorado for the use and benefit of the Department of Natural
<br /> Resources, Colorado Water Conservation Board ("CWCB") the beneficiary herein, whose
<br /> address is 1313 Sherman Street, Room 721, Denver, CO 80203, payable in 40 annual
<br /> installments, in accordance with said Promissory Note, or until the loan is paid in full.
<br /> The Grantor has also executed a Promissory Note dated September 13, 2011 to secure the
<br /> repayment of the indebtedness evidenced by Contract No. C153438, dated August 1, 1985,
<br /> as amended on September 13, 2011 for the total principal sum of $125,000, to be repaid to
<br /> the State of Colorado for the use and benefit of the Department of Natural Resources,
<br /> Colorado Water Conservation Board ("CWCB") the beneficiary herein, whose address is
<br /> 1313 Sherman Street, Room 721, Denver, CO 80203, payable in 40 annual installments, in
<br /> accordance with said Promissory Note, or until the loan is paid in full.
<br /> The Grantor has also executed a Promissory Note dated September 13, 2011 to secure the
<br /> repayment of the indebtedness evidenced by Contract No. C153501, dated August 6, 1987,
<br /> as amended on September 13, 2011 for the total principal sum of $125,000, to be repaid to
<br /> the State of Colorado for the use and benefit of the Department of Natural Resources,
<br /> Colorado Water Conservation Board ("CWCB") the beneficiary herein, whose address is
<br /> 1313 Sherman Street, Room 721, Denver, CO 80203, payable in 40 annual installments, in
<br /> accordance with said Promissory Note, or until the loan is paid in full.
