WHEREAS. the State and the Contractor entered into a
contract dated February 17. 1988. Contract E~cumbrance Number
C-153507 (hereinafter called the "Original Contract"): and

WHEREAS. the scope of the project identitied in the
original Contract was measurably increased during the final
design of the project: and

WHEREAS. one Of the conditions in the Original Contract was
that the project be completed within thirty (30) months of the
date of execution for said contract: and

WHEREAS. the increase in scope of the project and the
complexity of design for the project have caused the contractor
innumerable delays: and

WHEREAS. the increase in scope of the project has increased
the estimated cost of the project by over Three Hundred Fifty
Thousand Dollars ($350.000): and

WHEREAS. paragraph 2 of section 1 of Senate Bill No. 15
(1967) authorizes the Colorado Water Conservation Board to
increase the initial appropriation for this project "plus or
minus such amounts. if any. as may be justified by reason of
ordinary fluctuations in construction costs as indicated by the
engineering cost indices applicable to the types'of
construction involved for such projects or as may be justified
by reason of changes made in the plans for a'project if those
changes are required by final engineering drawings and
specifications or by federal or state requirem~nts:" and

WHEREAS. the engineering cost indices have increased by
7.2\ since this project was authorized under S.B. No. 15: and

WHEREAS. this amount of increase in the cost indices would
authorize the Colorado Water Conservation Board to increase its
loan on this project by Sixty-Two Thousand Five Hundred Dollars
($62.500) which represents fifty percent (50\) of the total
project cost incr~ase due to inflation; and

WHEREAS. the Colorado Water Conservation Board is also
authorized to increase the Original Contract amount by One
Hundred Seventy-Five Thousand Dollars ($175.000) due to the
increase in scope of the project.

NOW THEREFORE. it is hereby agreed as fOllows:

1. Consideration for this amendment to the Original
Contract. Contract Encumbrance Number C-153507. Routing Number
66323. dated February 17. 1966. consists of the payments which
shall be made pursuant to ~his amendment and the promises and
agreements herein set forth.
