The Charter was adopted pursuant <br />to the Home Rule provisions of the Colorado Constitution. <br /> <br />The Board under Section 17-4 of the Charter is granted the <br />power and is required to "Acquire, develop and protect <br />the water supplies decreed adjudicated or contracted for, <br />for the City of Greeley". <br /> <br />The dams of Commanche, Peterson and Twin Lakes are part <br />of the water supplies for the City of Greeley. <br /> <br />An election is not necessary as the Water Supply exception <br />and Home Rule provisions of the Colorado Constitution <br />apply. There are no provisions in Greeley's Code of <br />Ordinances, Charter or State law that prevents the <br />contract from binding Greeley. <br />
