.WHEREAS. required approval. cle::ar:lnl.:e and coordination ha~ been accomplished from and with appropriate
agenCIes; and

WHEREAS. a contract was entered into on July 1. 1986.
Contract Encumbrance Number C153467 (the Original Contract).
between the State and the Contractor; and

WHEREAS. the Original Contract provided. that the State
would pay fifty percent (50\) of the cost for the Contractor to
conduct feasibility studies for the rehabilitation of three
dams; namely. Comanche Dam. Peterson Dam and Twin Lakes Dam.
Fifty Percent (50\) of that cost is Sixty-Eight Thousand Five
Hundred Sixty Dollars ($68,560). as shown by Exhibit B of the
Original Contract: and

WHEREAS. Paragraphs 5. and 6. of the Original Contract
provided that the Contractor would repay the State Eighty-Eight
Thousand Seven Hundred Eighty-Five Dollars and Twenty Cents
($88.785.20) in ten (10) equal annual payments of Eight
Thousand Eight Hundred Seventy-Eight Dollars and Fifty-Two
Cents ($8.878.52) each if the rehabilitation of the three dams
was initiated within ten (10) years of the effective date of
the Original Contract; and

WHEREAS. the repayment provisions .of Paragraphs 5. and 6. of
the Original Contract were intended by the parties to apply in
a proportionate cost amount to any part of the three dam water
projects. as long as the rehabilitation of such part is
initiated within the specified time; and

WHEREAS. the total repayment to the State of Eighty-Eight
Thousand Seven Hundred Eighty-Five Dollars and Twenty Cents
($88,785.20) was derived by adding a five percent (5\) per
annum service charge to the fifty percent (50\) State payment
of Sixty-Eight Thousand Five Hundred Sixty Dollars ($68.560)
for preparing the three feasibility reports. which fee is shown
in Exhibit B of the Original Contract; and

WHEREAS~ the Contractor desires to enter into a Project
Contract with the State at this time to proceed with the
rehabilitation of the Comanche Dam only. The initiation of
this Comanche Dam rehabilitation would activate the repayment
provisions of Paragraphs 5. and 6. of the Original Contract for
repayment by the Contractor to the State of a proportionate
cost amount provided by the State for the Comanche Dam; and

I WHEREAS. the proportionate share of the Eighty-Eight
Thousand Seven Hundred Eighty-Five Dollars and Twenty Cents
($88.785.20) for the Comanche Dam feasibility report is
Thirty-Four Thousand Four Hundred Ninety-Eight Dollars and
Eighty Cents ($34.498.80). This amount of Thirty-Four Thousand
Four Hundred Ninety-Eight Dollars and Eighty Cents ($34.498.80)
