The Contractor agrees to indemnify and hold the State harmless from any liability as a result of the State's interest in the project facilities and any other property identified in paragraph A.5. above. The Contractor shall maintain general liability insurance covering the management. operation. and maintenance of the project until it completes repayment to the State in at least the fOllowing amounts: a. For any injury to one person in any single occurrence. the sum of Five Hundred Thousand Dollars ($500.000). b. For any injury to two or more persons in any single occurrence. the sum Of One Million Dollars ($1,000.000). -- Said liability insurance for this project shall name the State as a co-insured. A copy of a certification of said liability insurance or evidence that the Contractor can provide the specified insuranoe coverage through a self-insurance program must be filed with the Colorado Water Conservation Board prior to the start of the operation of the project system. 8. Make the services of said project available within its capacity and in accordance with its rules and regulations. and operational guidelines. to all persons in the Contractor's service area without discrimination as to race. color. religion. or national origin at reasonable charges (including assessments. taxes. or fees), whether for one or mor~ classes of service. in'accordance with a schedule of such charges formally adopted by the Contractor through its City Council, as may be modified from time to time. The Contractor hereby states and affirms that the rate schedule adopted by the Water and Sewer Board a~d the City Council in accordance with the Charter of the City of Greeley must and shall provide for the generation of sufficient revenues for: (1) the operation and maintenance of the water system; (2) debt service requirements including repaymeht of the project loan authorized by this contract: and (3) additions to a reserve account to offset depreciation to the water system. The Contractor may make such modification to the rate schedule as the Contractor 6eems necessary to efficiently and economically provide for the financial requirements of the system. The rate schedule shall remain reasonable and non-discriminatory. -"""'-- ---~ 9. Adjust its operating costs and service charges from time to time to provide for adequate operation and maintenance. emergency repair services. obsolescence reserves. and debt reserves. 10. Provide the State with such periOdic reports as the State may require and permit periOdic inspections of its operations and accounts by a designated representative of the State, 11. Repay to the State the total project loan principal for the design. and construction of this project. in the amount of Eight Hundred ThirtY-Five Thousand Eight Hundred Sixty Dollars ($835,860), together with the amount of Twenty-Six Thousand Six Hundred Forty Dollars ($26.640) previously advanced by the State for the feasibility study of Comanche Dam. for a total principal repayment cost not to exceed Eight Hundred Sixty-Two Thousand Five Hundred Dollars ($862.500). plUS accumulated interest calculated using accepted accounting prinCiples at a rate of five percent (5') per annum. said repayment to be made in constant annual installments.
