HIGBEE <br /> <br />STATE OF COLORADO <br /> <br />ss. <br /> <br />COUNTY OF PROWERS <br /> <br />I, Donald F. Higbee, being first duly sworn upon oath, state <br /> <br />as follows: <br /> <br />1. I am and have been a member of the Board of <br />Directors of the Lower Arkansas Water Management Association ("LAWMAn) <br />since 19B7. I have been LAWMA's Secretary and Treasurer since 1994. <br /> <br />2. LAWMA's directors are elected for three-year terms <br />by LAWMA's members. LAWMA's members meet on an annual basis and cast <br />their votes through ballots that reflect the number of votes to which <br />each member is entitled. <br /> <br />3. One of my duties as Secretary and Treasurer of LAWMA <br />is to, prior to the annual members meeting, calculate the number of <br />votes each LAWMA member is entitled to and prepare ballot forms <br />reflecting that number. <br /> <br />4. While in my position as Secretary and Treasurer of <br />LAWMA and until the 1995 election, the method used to calculate the <br />number of votes each member was entitled to was: one vote per $25 <br />increment paid into LAWMA during the previous year. This method is <br />consistent with the voting method described in LAWMA's Bylaws. <br /> <br />5.
