<br />WHEREAS, re4uired approval. c1eara!"ce :md coordination has been accomplished from and ~ith appropriate
<br />agencies: and' -
<br />
<br />WHE~EAS., pursuant to the provisions of section 37-60-119,
<br />Colorado Revised Statutes, as amended, the State is authorized to
<br />construct certain water projects for the benefit of the people of
<br />.the State of Colorado; and
<br />
<br />WHEREAS, the Grand Mesa Water Conservancy.District has made
<br />application to the State for the improvement of its existing
<br />facility, such improvement of the facility is hereinafter
<br />sometimes referred to as the project i and..
<br />
<br />WHEREAS, the Contractor was selected in accordance with the
<br />provisions of 24~30-l40l, et s~q., Colorado Revised Statutes
<br />1982, and the Contractor has executed the Certificate attached
<br />hereto as Exhibit B, which provisions are incorporated, hereip by
<br />reference, pursuant to 24-30-1404, Colorado Revised Statutes
<br />i9B2; and
<br />
<br />WHEREAS, the Contractor is ~ professional engineering firm
<br />within the State of Colorado;
<br />
<br />NOW THEREFORE, it is hereby agreed that:
<br />
<br />1.. The Contractor shall pr'epare a feasibility report
<br />directed to the problem of improving the facilities of the
<br />Grand Mes~ Water Conbervancy District in accordance with a
<br />proposal- .for a.- project feasibility report prepared by him
<br />and 'approved by the State, received August 12, 1985, 'which
<br />propos~l is attached heretq as Exhibit C and made a part of this
<br />contract.

<br />. \ 2. Fifteen (15) copies of the final report called for in
<br />~his contract shall be furnished to the State' not later, than
<br />Feb. 3 Jafl~aEl 12, 1986, unless such time is extended by mutual
<br />~ agreement of the parties hereto in writing.
<br />
<br />3. As compensation for the services of the Contractor, the
<br />State shall pay to the Contractor the sum of Seventy~Four
<br />Thousand Dollars ($74,000) in the manner fOllowing:
<br />
<br />a. Sixty percent (60%), to wit, Forty-Four Thousand Four
<br />Hundred Dollars ($44,400) of the total 'amount due in two
<br />(2) monthly installments of Twenty-Two Thousand Two
<br />Hundred Two Dollars ($.22,200) each, commencing on
<br />October 1, 1985,
<br />
<br />b. The remaining forty percent (40%), to wit,
<br />Twenty-Nine Thousand Six Hundred Dollars ($29,600)
<br />within forty (40) days following receipt and acceptance
<br />of the written report specified in para9raph 2 of this
<br />contract.
