<br />. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />lOci <br /> <br />. <br /> <br />RECEIVED <br />NOV 1 5 1995 <br /> <br />Colorado Water <br />Conservalioo Board <br /> <br />TOWN OF LYONS, COLORADO <br />RESOLUTION NO. 1995-9 <br /> <br />A RESOLUTION CALLING AN ELECTION ON NOVEMBER 7, 1995, <br />TO AUTHORIZE THE ISSUANCE OF WATER ANn WASTEWATER REVENUE <br />OBLIGATIONS OF THE TOWN FOR THE PURPOSE OF FINANCING <br />WATER AND WASTEWATER IMPROVEMENTS; AND SETTING THE BALLOT <br />TITLE AND BALLOT QUESTION FOR THE FOREGOING. <br /> <br />WHEREAS, the Town of Lyons' wastewater treatment plant (the .WWTp., is <br />subject to current total suspended solids violations; and <br /> <br />WHEREAS, the WWTP has inadequate aerobic digestion volume and is thus <br />unable to meet new sludge regulations; and <br /> <br />WHEREAS, the WWTP is subject to wintertime freezing of its unenclosed <br />treatment unit; and <br /> <br />WHEREAS, the Town of Lyons' water treatment plant (the .WTp., requires a <br />clearwell structure and associated piping changes to meet State of Colorado <br />standards for the disinfection process to destroy pathogenic organisms; and <br /> <br />WHEREAS, the WTP's sole intake structure on the north St. Vrain is in an <br />extreme state of deterioration; and <br /> <br />WHEREAS, the WTP's intake structure cannot divert river water into the WTP ~ <br />in periods of cold weather and minimum stream flow; and <br /> <br />WHEREAS, the extremely poor condition of the intake structure could lead <br />to the structure failing during high water in the spring; and <br /> <br />WHEREAS, the WTP is in need of design changes to the clarification, <br />flocculation and sedimentation process to deal with turbidity and other <br />standards; and <br /> <br />WHEREAS, the condition of the WTP has in recent months forced the Town of <br />Lyons to twice notify its drinking water customers of certain substandard <br />conditions; and <br /> <br />WHEREAS, backup electric power and pumping capacity is needed at the WTP <br />in order to insure consistent supply without failure to the WTP's users; and <br /> <br />WHEREAS, the Town of Lyons' domestic water supply is dependent upon a <br />storage tank located at a vulnerable distance from the users of the WTP and thus <br />closer additional storage is needed for emergency storage and fire protection; <br />and <br /> <br />WHEREAS, many of the standards the Town of Lyons is called upon to meet <br />have recently been established, and thus have not previously been met; and <br /> <br />WHEREAS, the Board of Trustees (the "Board"' of the Town of Lyons, Boulder <br />County, Colorado (the "Town"', has determined that the public interest and the <br />
