Contract Encumbrance NumberC1534 7 8; and <br />ABL Account Number 16053, Org. Unit 77-77-777, <br />WHEREAS. reljoircd appro...:.!. clearance and cotlrdinaliun has been accomplished from and wilh appropriate <br />agt'ncies: and <br /> <br />WHEREAS. on November 14. 1986, the State entered into the <br />~Original Contract.' (Appendix A) with the Contractor, which <br />Original Contract provided financing to the Contractor to <br />undertake repairs to the existing Rio Grande Dam; and <br /> <br />WHEREAS. on May 11. 1987. that Original Contract was <br />amended (Attachment A) to provide additional money to the <br />Contractor because the construction bids received were higher <br />than the State.s estimates; and <br /> <br />WHEREAS. now a second contract amendment is needed in order <br />to increase the grant and loan amounts in the total amount of <br />One Hundred Twenty Thousand Five Hundred Thirty-Five Dollars <br />and Thirty-Two Cents ($120,535.32); and <br /> <br />WHEREAS, Senate Bill No. 27. Fifty-Fifth General Assembly <br />of the State of Colorado. has authorized that the loan and/or <br />grant combination of Seven Hundred Thousand Dollars ($700.000) <br />may be increased by the State in such amounts as may be <br />justified by reason of ordinary fluctuations in costs or <br />changes made in the plans for the project if those changes are <br />required by final engineering drawings and specifications or by <br />State requirements; and <br /> <br />WHEREAS. a total of One Hundred Twenty Thousand Five <br />Hundred Thirty-Five Dollars and Thirty-Two Cents ($120.535.32) <br />in increases in the grant amount and in the loan amount. as <br />described below. has been made necessary because of changes in <br />the plans as required by final drawings and because of changes <br />made in the overall construction and management of the project <br />as required by the State: and <br /> <br />WHEREAS. Sixty-Nine Thousand Six Hundred Seven Dollars and <br />Eighty-Two Cents ($69.607.82) in increases. Thirty-One Thousand <br />Six Hundred One Dollars and Ninety-Five Cents ($31.601.95) in <br />loans and Thirty-Eight Thousand Five Dollars and Eighty-Seven <br />Cents ($38.005.87) in grants. was made necessary after the <br />reservoir was inspected empty and engineering drawings and <br />specifications were revised as necessary and construction bids <br />based on these revised plans and specifications received for <br />the Rio Grande Dam were higher than the State.s original <br />estimates: and <br /> <br />WHEREAS. a One Thousand Two Hundred Fifty Dollars ($1.250) <br />increase in the loan amount has been made necessary because of <br />interest charges on construction bills submitted by the current <br />Construction Firm. and a Forty-Nine Thousand Six Hundred <br />Seventy-Seven Dollars and Fifty Cents ($49.677.50) increase in <br />the loan amount has been made necessary because of attorneys. <br />fees incurred by the Contractor for legal services due to <br />changes in the general project situation and State requirements <br />and decisions. as further described hereafter; and <br /> <br />39S5l<rJ-1O'14 <br /> <br />Page I of ~ pages <br />.,Sce insUU~'lions on rever!oC of lau page.) <br /> <br />6J16E <br />
