<br />1. Authority exists in the law, and funds have beenbudgeted, appropriated, and otherwise made available and

<br />a sufficient unencumbered balance thereof remains available .for payment in Fund Number 424, Appropriation Code
<br />362, Contract En'cumbrance Number C153618; and ''fi.'

<br />3. The STATE and the CONTRACTOR entered into a contr ct dated July 17, 1992, Contract Routing Number
<br />93070, Contract Encumbrance Number C153618, hereinafte referred to as ORIGINAL CONTRACT, wherein the STATE
<br />agreed to loim money in the total amount of $380,000 ($354,360 for project construction and $23,640 for feasibility
<br />report contract) to the CONTRACTOR to be used for enlargement and rehabilitation of Peterson Dam, and the CONTRACTOR
<br />agreed to repay the loan in accordance with the. terms of .the ORIGINAL CONTRACT; and

<br />4. . Paragraph A.2 of the ORIGiNAL CONTRACT states thaHhe completion date bf the PROJECT is to be within two
<br />and one-half (2 1/2) years from the date of t.he ORIGINA'L CONTRACTUnless extended by the STATE due to circumstances
<br />beyond the control of the CONTRACTOR; and .

<br />5. CONTRACTOR has supplied a letter dated June 9,1'994, attached hereto as Exhibit A and made a part hereof,
<br />requesting an extension for the date of completion, and explaining the need and reason for the extension; and
<br />
<br />6. The STATE has reviewed the situation and is satisfied that the CONTRACTOR'S need for an extension of one
<br />year is reasonable and necessary; and
<br />
<br />7. The STATE and the CONTRACTOR agree to extend the time for completion of the ORIGINAL CONTRACT by one
<br />i1) year to January 17, 1996; and
<br />
<br />8. CONTRACTOR has supplied a letter dated August 25, 1994, with engineers construction cost estimate in the
<br />amount of $1,241,1 93 attached hereto as Exhibit B and made a part hereof, requesting an adjustment in the amount
<br />of the project construction loan from $356,360 to $620,596 based on the changes required by the final design; and

<br />9. In accordance with Section 1, Chapter 32 'of the 1987 Colorado Session Laws, the loan amounts may be the
<br />amounts authorized, plus or minus such amounts as may be justified by reason of changes made in the plans for a
<br />project if those changes are required by final engineering drawings and specifications, however, such loan shall n6t
<br />exceed 50% of the total cost of constructing the project; and

<br />10, The STATE has reviewed the letter and engineers construction cost estimate and has determined that there
<br />is a valid reason for adjusting the amount of the loan to $620,596; and
