<br />WHEREAS, a contract was entered irtto on July 1, 1986, Contract
<br />Encumbrance Number C153467 (the Oriqinal Contract), between the
<br />State and the Contractor; and
<br />
<br />WHEREAS, the Oriqinal Contract provided that the state would
<br />pay fifty percent (50%) of the cost for the Contractor to conduct
<br />feasibility studies for the rehabilitation of three dams; namely,
<br />Comanche Dam, Peterson Dam and Twin Lakes Dam. Fifty Percent (50%)
<br />of that cost is'Sixty-Eiqht Thousand Five Hundred sixty Dollars
<br />($68,560), as shown by Exhibit B of the Oriqinal Contract; and
<br />
<br />WHEREAS, on February 17, 1988, an amendment to the oriqinal
<br />Contract was entered into between the State and the Contractor
<br />which removed Twenty-Six Thousand six Hundred Forty Dollars
<br />($26,640), the proportionate share of the Comanche Dam feasibility
<br />study only, from the oriqinal Sixty-Eiqht-Thousand-Five-Hundred-
<br />Sixty-Dollar ($68,560) State appropriation for the three
<br />feasibility studies; and
<br />
<br />WHEREAS, on February 17, 1988, a Project Contract was entered
<br />into between the State and the Contractor for the rehabilitation of
<br />the Comanche Dam and the Twenty-Six-Thousand-Six-Hundred-Forty-
<br />Dollar ($26,640) cost of the Comanche Dam feasibility stUdy was
<br />added to that contract; and
<br />
<br />WHEREAS, The Contractor now wishes to add Contract Amendment #2
<br />to the oriqinal Contract with the State which will remove an
<br />additional Twenty-Three Thousand six Hundred Forty Dollars
<br />($23,640), the proportionate share of the Peterson Dam feasibility
<br />study only, from the Oriqinal Contract; and
<br />
<br />WHEREAS, the Contractor now desires to enter into a Project
<br />Contract with the State.to proceed with the rehabilitation of
<br />Pet~rson Dam; and
<br />
<br />WHEREAS, the Contractor wishes to add the Twenty-Three Thousand
<br />six Hundred Forty Dollars ($23,640) deleted from the oriqinal
<br />Contract to the repayment schedule for the proposed Peterson Dam
<br />rehabilitation Project Contract; and . c .

<br />~ WHEREAS, pursuant to Senate Bill No. 15, Fifty-Sixth General
<br />\ Assembly of the State of Colorado, duly enacted into law, the State
<br />, has been authorized to enter into a Project Contract to loan a sum
<br />\ not to exceed Three Hundred Eiqhty Thousand Dollars ($380,000) for
<br />\ the rehabilitation of peterson Dam, which includes Twenty-Three
<br />Thousand six Hundred Forty Dollars ($23,640) as the State~s share
<br />of the feasibility report for Peter~on Dam, as shown in Exhibit B
<br />of the Oriqinal Contract; and
