<br />WHEREAS; pursuant to the provisions of 37-60-119, Colorado
<br />. Revised statutes, the State is authorized to loan money for the
<br />construction of water projects for the benefit of the people of
<br />the state;' and .

<br />WHEREAS, the Contractor is a duly constituted Home Rule city
<br />in the state of Colorado and wishes to construct, or cause to be
<br />const'ruct~d,. the enlargement .and rehabilitation of its Peterson
<br /><oa'm".and ,a'P1?urtenant_,~tructures, hereinafter called the project,
<br />'iwhich' ~s',,').oc.ated -in.' Larimer County, Colorado, at ail estimated cost

<br />projectis'teclinically and financially feasible. The feasibility
<br />report contract. has, 'been_, -.amended to' include repayment of the
<br />state I s sha:r;e 9f the "-feasibility report which relates to the
<br />rehabilitation of Peterson Reservoir with repayment of this

<br />WHEREAS, the state has now agreed to loan money for the
<br />construction of'said project upon mutually agreeable terms and
<br />conditions, subject to the availability of funding for that
<br />purpose; ..!:ih9.,.....

<br />WHEREAS,'pursuant to Senate ilill No. 15, Fifty-Sixth General
<br />Assembly of the state of Colorado, duly enacted into law, the
<br />state .has been authorized to loan a sum not to exceed Three
<br />Hundred Eighty Thousand 'Dollars ($380,000) for the feasibility
<br />report and the. construction of t~e 'project;

<br />WHEREAS', '. tt1"e Contractor desires to include the repayment of
<br />the sum of. Twenty-Three Thousand six Hundred Forty Dollars
<br />($23, 640) ,'::-'prev~ous:fy.. advanced by the state for the feasibility
<br />.'.' study of Peterson Dam, in its repayment of the loan of Three

<br />A. The Contractor agrees that it' shall:

<br />1. Employ an. engineering firm to prepare project plans and
<br />specificationilfor the project, Both the engineering firm and the
<br />project plans'anq specifications muat be approved by the State
<br />before initiation of construction on the project, including any
<br />real estate a~d water rights acquisitions, can commence.
