Revised Statutes, the State is authorized to loan money for the
construction of water projects for the benefit of the people of
the State: and

WHEREAS. the Contractor is a duly cOhstituted Watershed
Conservancy District in the State 0 lotado: and

General Assembly of the Sta~~f ~ora . duly enacted into

WHEREAS, p~f~asi~ilitY_i vestigation of said project was
conducted and it\i.t'a~;"foun~hat such a project is technically
and financially f~~s}ble: and

WHEREAS. the ~ has previously loaned the Contractor
One Hundred Thousa~~~~llars ($100,000) for Phases I and II of
the project, and said funds have been expended by the
Contractor on Phases I and II of the project; and

WHEREAS, the Contractor wishes to acquire lands,
easements. and/or rights-of-way required for Phase III of the
construction of the project for the community in Sedgwick
county. colorado, at an estimated cost of seventy-Five Thousand
Dollars ($75.000); and

WHEREAS. the State has now agreed to loan money for the
construction of Phase II of said project upon mutually
agreeable terms and conditions, SUbject to the availability of
funding for that purpose:

NOW, THEREFORE, in consideration of the mutual and
dependent covenants herein contained. it is agreed by the
parties hereto as follows:

The Contractor agrees that it shall:

1. Employ an engineering firm to prepare project plans
and specifications for the project. Both the engineering firm
and the project plans and specifications must be approved by
the State before initiation of construction on the project,
including any real estate and water rights acquisitions, can
commence.

2. Contract for the construction of said project to a
responsible and capable firm or firms (hereinafter referred to
as construction Firm or Firms), Which construction Firms shall.
