C., 104 West
First Street, JUlesburg, Colorado. Directors McClary and
Cumming were also present as was Attorney Max E. Carlson.

The purpose of the meeting was declared to be for
consideration of two Contracts received from the State
Water Conservation Board. The first Contract is dated
March 2, 1987 and is an amendment to an earlier contract
in the amount of $67,000.00 dated December 1, 1982. The
second Contract is in the amount of $75,000.00 and is
dated March 1, 1987 and represents additional loan
proceeds to be received from the Colorado Water
Conservation Board.

After reviewing the proposed Contracts, it was
moved by Director Cumming and seconded by Director
McClary that the Contracts be executed by President
Otsuka on behalf of the District and returned to the
Colorado Water Conservation Board. The President called
for a vote and said motion was unanimously passed. The
Directors expressed concern regarding the requirement of
liability insurance on the District's dams in the amount
of $150,000.00 for injury to one person and $400,000.00
for injury to two or more persons in any single
occurrence. It was noted that at the time of the
execution of this Contract, the availability of said
insurance and the cost of said insurance is unknown to
the Directors and remains unknown even after diligent
. '
inquiry. It was decided that a cover letter to the
Colorado Water Conservation Board expressing the
Directors' concern would be sent with ~he executed
Contracts so that the Colorado Water Conservation Board
would be aware of the Directors' concern in this regard.

1
