A motion was made by Bob Burr that the Board accept the staff
recommendation that based on the procedures outlined in Section 8 of the
Rules, and the information contained within and attached to the
memorandum that the Board has received, and the information received in
the September meeting, and the oral presentations of the staff and others,
the staff recommends that the Board approve the request to inundate,
subject to the applicant's agreement to abide by the terms and conditions
of the attached stipulation, acknowledging that the stipulation does not
pertain to any fencing at this point, but does include an assurance that the
fish stocked within the reservoir would not compete with existing Colorado
River Cutthroat populations in Antelope Creek and that the applicant would
allow the CDOW to investigate the possibilities of using Matheson
Reservoir as a brood facility for Colorado River 'Cutthroat Trout. It was
also entered into the record that the applicant shall abide by all other terms
of the stipulations, which were read out loud. The motion was seconded
simultaneously by David Smith and Ray Wemer and approved
nnanimously (8-0).

8a. Water Project Construction Loan Program - Changes in Existing Projects _ Left
Hand Ditch Co. - Left Hand VaDey Reservoir Spillway

Action: A motion was made by David Smith to accept the staff recommendation
to increase the loan by $190,000 for a total loan amount of $560,000,
under the original blended 1995 agricultural and municipal rates, or
4.375% for 30 years. The motion was seconded Allen Davey and
approved unanimously (8-0).
