T1.°' c:-4a� ..2J1 �� --f'.9G <br />-{-- � - " ��` `) <br />� <br />RESOLUTION <br />WIi�REAS� the Bosrd of directors oi the Cono,tos Water <br />Conservancy Dlstrlct has dotermined that ..lt is in tho best <br />lnterests of the Aistrlct wator users to create and malntain a <br />wster activlty entorprlse pursuant to Sectfon 37-46.1••103 of the <br />Colorado Revised Statutes tor the purpose o! adminlstering thc <br />storage and distribution of waier in Platoro Reservo.jr.,�id tl�e _.,__, <br />revenue produced from the sale of such stored-xater; a-nd <br />WHERCAS, the Board of Directors of the ConeJos Water <br />Conservancy District Aas determined that the namo of the <br />vttterprise shall be Platoro Reservolr Enterprise; and <br />WHEREAS, Platoro Reservolr Enterprise shall be wholly owned <br />by the ConeJos Water Conservancy District; and <br />WHEREAS, the Hoard o£ Dlrectors of the Cunejos Water <br />ConservanCy Dlstrlct� in addition to their regular dutles in <br />c�nnRr.t inn therewith, shall. als:o-scrt_e-as -_�ho---Boa-rd--oS�-DSnoc-tors <br />of Platoro Fteservoir Enterprlse; and <br />WHEREAS, the Board of directors of Platoro Reservolr <br />Entorprlse may exercise all legal authority oi ilie ConeJos Wat�r <br />Conservancy District rolating to water activities appertaining to <br />Platoro Fiesorvoir� but may not levy any tax whlch is subJect to <br />Sectlon 20(4) of Articla X of the State Constitution; and <br />WFIEREAS� the Board of Dlrectors oi the ConeJos Water <br />Conservancy District bareby determines that the purpose for the <br />creation of Platoro Reservolr Enterprlse !s to operate, ma.lntain, _ <br />repalr and replace the Platoro Roservoir Project, and to conduct <br />�wator activltios tl�at 1t�clude, but are not lSmlted to the <br />diversion� storage, carriage, delivery� distribution, use, <br />augmentation� exchange, reuse or discharge of water, as woll as <br />storage for interstate compact obligations, and includes th� <br />provlsion for tha wholesale or retall sale of watar, and the <br />aaquisltlon of water or waier rigLts. <br />NOW, THEREFORE, $E IT RESOLVED that the Board of Direotors <br />___.__., of the Cona.los Water Conservancy Distrlct heraby creates ap_._ _..._.... <br />enterprlse, named Platoro Reservalr Enterprise, and names tho <br />Board of �Irectors oi the ConeJos Water Conservancy Distrlct to <br />also serve as the Board of Dlrectors oi Platoro Reservolr <br />£nterprisa. <br />BE IT FllRTHER R�SOLVED that a separate accounting oi funds <br />of Ylatoro Reservolr Enterprise wlll be distinct ;and separato <br />irom all other funds oi the Conejos Water Conscrvancy Distrlct. <br />
