APPENDIX A
RESOLUTION
WHEREAS, the Board of directors of the 'ConeJos Water
Conservancy District has determined that it is tn the best
interests of the Distrlct water users to create and maintain a
water activity enterprise pursuant to Section 37-45.1-103 of the
Colorado Revised Statutes for the purpose of administering the
storage and dlstrlbution of water in Platoro Reservoir, and the
revenue produced from the sale of such stored water; and
WHEREAS, the Board of Directors of the ConeJos Water
Conservancy District has determined that the name of the
enterprise shall be Platoro Reservoir Enterprise; and
WHEREAS, Platoro Reservoir Enterprise shall be wholly owned
by the Cone�os Water Conservancy District; and
WHEREAS, the Board of Directors of the Conejos Water
Conservancy District, in addltion to their regular dutles in
connection therewlth, shall also serve as the Board of Dlrectors
of Platoro Reservoir Enterprtse; and
WHEREAS, the Board of directors of Platoro Reservoir
Enterprise may exercise all legal authority of the ConeJos Wat�r
� Conservancy District relating to water activlties appertalning to
Platoro Reservoir, but may not levy any tax whlch is sub�ect to
Section 20(4) of Article X of the State Constitution; and
�
WHEREAS, the Board of Dlrectors of the ConeJos Water
„ Conservancy District hereby determines that the purpose for the
creation of Platoro Reservolr Enterprise is to operate, maintain,
repalr and replace the Platoro Reservoir ProJect, and to conduct
water activlties that include, but are not limited to the
- diversion, storage, carrlage, dellvery, distribution, use,
augmentation, exchange, reuse or discharge of water, as well as
storage for interstate compact obllgations, and lncludes the
provision for the wholesale or retall sale of water, and the
acquisition of water or water rights.
NOW, THEREFORE, BE.IT RESOLVED that. the Board of Dlrectors
of the Cone�os Water Conservancy District hereby creates an
enterprise, named Platoro Reservoir Enterprise, and names the
Board of Directors of the ConeJos Water Conservancy District to
also serve as the Board of Dlrectors of Platoro Reservolr
Enterprise.
BE IT FIIRTHER RESOLVED that a separate accounting of funds
of Platoro Reservoir Enterprlse will be dlstinct ;and separate
from all other funds of the ConeJos Water Conservancy Dlstrict.
