<br />PROJECT CONTRACT
<br />THIS CONTRACT is made this � day of ���,/ 1993, by
<br />and between the State of Colorado for the use and benefit of the
<br />Department of Natural Resources (Colorado Water Conservation
<br />Board), hereinafter referred to as the State, and Conejos Water
<br />Conservancy District and Platoro Reservoir Enterprise, 318 Main
<br />Street, Manassa, Colorado, 81141„ both entities are hereinafter
<br />referred to as the Contractor or Borrower.
<br />WHEREAS, authority exists in the Law and Funds have been
<br />budgeted, appropriated and otherwise made available and a
<br />sufficient unencumbered balance thereof remains available for
<br />payment in Fund Number ,1� , Appropriation ,�,/y, Organization
<br />�, Program �� Contract EnCUmbrance Number, '�6 ; and
<br />WHEREAS, required approval, clearance and coordination has
<br />been accomplished from and with appropriate agencies; and
<br />WHEREAS, pursuant to the provisions of §37-60-119, Colorado
<br />Revised Statutes, the State is authorized to loan and grant money
<br />for the construction of water projects for the benefit of the
<br />people of the State of Colorado; and
<br />WHEREAS, the Conejos Water Conservancy District is a water
<br />conservancy district in the State of Colorado created and operated
<br />pursuant to Article 45, Title 37, C.R.S.; and
<br />WHEREAS, the Platoro Reservoir Enterprise was established
<br />pursuant to §37-45.1-103, C.R.S, by resolution of the Board of
<br />Directors of the District dated July 7, 1993, attached hereto as
<br />Appendix A and incorporated herein by this reference. The purpose
<br />for the creation of the Platoro Reservoir Enterprise was to
<br />operate, maintain, repair and replace the Platoro Reservoir Project
<br />and to conduct all water activities related to that Project; and
<br />WHEREAS, the Contractor and the United States entered into a
<br />contract dated March 13, 1949 (Contract No. I1r-1529), which was
<br />amended on October 27, 1952, supplemented on June 3, 1958, and
<br />amended on August 19, 1960, collectively referred to hereafter as
<br />the Repayment Contract, covering construction and use of Platoro
