STATUS OF EXISTING WATER RIGHTS. <br /> <br />A review of the water rights indicates that there are <br />several items that need to be resolved: <br /> <br />1. The exact source of all the surface diversion rights <br />should be verified. This should be formalized in an <br />official ruling of the water court. <br /> <br />2. It needs to be determined if the irrigation right <br />(No. 511) from Gardner Spring can be used for <br />domestic purposes and if Priority #478 can be used <br />in the non-irrigation season. It was also not clear <br />if there were other water users on Gardner springs. <br /> <br />3. A complete abstract of all transactions involving <br />the Town's water rights should be assembled so the <br />historical pattern of exchange can be documented. <br /> <br />4. The relative priorities of the water rights in San <br />Miguel Basin should be determined. This would <br />indicate whether the water rights would be available <br />during dry years. <br />
