<br />.f <br /> <br />/".. <br /> <br />. , <br /> <br />AGENCY NAME: Water Conservation Board <br /> <br />AGENCY NUMBER: PDA <br />ROUTING NUMBER: () , 0'.:)_, <br />$ 310,101010 <br /> <br />]fOfNT lFUNDfNG AGRlEJEMJENT <br /> <br />f1Dlk <br />This Agreement. made this, - day of June 1997, by and between the State of <br />Colorado for the use and benefit of the Department of Natural Resources, Colorado Water Conservation <br />Board ("CWCB"), hereinafter referred to as the STATE, and the U.S. GEOLOGICAL SURVEY, UNITED <br />STATES DEPARTMENT OF THE INTERIOR, Box 25046 M.S. 415, Denver Federal Center, Denver, Colorado <br />80225, hereinafter referred to as the USGS.. <br /> <br />IFACTUAL REClfTALS <br /> <br />A. Authority exists in the law, and funds have been budgeted, appropriated and otherwise made <br />available and a sufficient unencumbered balance thereof remains available for payment in Fund <br />Number 424, Organization YYYY, Appropriation SEV, Program WTRC, Object Code 5120, <br />Reporting Category 3766, Agreement Encumbrance Number C153766. <br /> <br />B. Required approval, clearance, and coordination have been accomplished from and with appropriate <br />agencies. <br /> <br />C. Pursuant to Senate Bill 96-170, Section 3(d), the STATE is authorized to fund water resource <br />planning at the local level in an amount of up to $100,000 from the Operational Account of the <br />Severance Tax Trust Fund created by ~ 39-29-109(1)(a), as amended by Senate Bill 96-170. <br /> <br />D. The USGS is conducting a study entitled "Hydrogeologic Characteristics Of The Shallow Aquifers In <br />The Boulder-Fort Collins-Greeley-Brighton Area Of The Colorado Front Range," hereinafter referred <br />to as the STUDY. <br /> <br />E. The STATE has agreed to participate in the STUDY, the results of which will assist govemmental <br />agencies and water users in local water resources planning. <br /> <br />F. At its November 1996 meeting, the CWCB approved the expenditure of $30,000 from the <br />Operational Account of the Severance Tax Trust Fund to participate in the STUDY. <br /> <br />Now Therefore, in consideration of the mutual and dependent covenants contained herein, the <br />parties agree as follows: <br /> <br />1. Cooperation of parties. The parties agree to cooperate on the STUDY, subject to the availability of <br />appropriations and in accordance with their respective authorities, by sharing in the costs of the <br />STUDY in conformity with the laws and regulations respectively governing each party in the amounts <br />described below. <br /> <br />2. Study performance. Hydrologists, geologists and technicians working for the USGS andlor the <br />Colorado Office of the State Engineer shall undertake the STUDY under the direction of the USGS in <br />accordance with the Project Proposal attached hereto as Appendix A. and incorporated herein. <br /> <br />3. Time of performance. The USGS shall use its best efforts to complete the STUDY within three (3) <br />years from the date of this agreement. <br /> <br />4. Availability of funds.
