<br />r <br /> <br />A. contractor agrees that it will; <br /> <br />1. Cause said project to be constructed within two years <br />of the date of this contract in accordance with the project <br />plans and specifications and any necessary modifications <br />thereof prepared by it as approved by the state, unless such <br />time is ext,ended by the state, or unless such time is <br />insufficient because of acts of God or other acts or "failure <br />to act beyond the control of the contractor. <br /> <br />2. Conveyor cause title to be conveyed to the' state by <br />deed or other proper conveyance, subject only to the agree- <br />ments with the Farmers Home Administration of the united <br />States, to the Colorado' Water Conservation Board, Department <br />of Natural Resources, state of Colorado, for "the following <br />portions of the proposed project facilities, all included in <br />contract No. I: <br /> <br />a. An 18-inch pipeline with all necessary fittings, <br />valves, vaults (including a pressure sustaining .vault), <br />and other appurtenances from station 49.+ 45 to station <br />191 + 53.45.1 except 300 feet of the White River Crossing, <br />between Station 68 + SOland station 72 + 50 (approxi- <br />mately). <br /> <br />b. All crossings. necessary and described in construc- <br />tion drawings and specifications between the above. <br />stations, except the.White River Crossing. <br /> <br />c. Engineering for the above (7.2% bid prices) <br />amounting to Thirty-Three Thousand Five Hundred Eighty- <br />Two Dollars ($33.582). <br /> <br />3. Permit periodic inspection of construction by the <br />authorized representatives of the state during construction <br />and permit the state to review and appro~e or disapprove any <br />contracts for the construction of the project. <br /> <br />4. Without expense to the state, manage, operate and <br />maintain the.project system continuously in an efficient and <br />economical manner. .and assume all legal liability for such <br />management, operation and .maintenance. <br /> <br />5. Make the services of said project available. within its <br />capacity to all persons in the Contractor's service area <br />without dis~rimination as to race, color, religion or <br />natural origin at reasonable charges, including assessments, <br />taxes or fees 1n accordance with a schedule of such charges, <br />whether for one or more classes of service, formally adopted <br />by the contractor through its board of directors, as may be <br />modified from time to time by the contractor. The initial <br />.rate schedule must be approved by the state. Thereafter, <br />the Contractor may .make such .modifications to the rate <br />s'chedule as the contractor deems necessary to efficiently <br />and economically provide for the financial requirements of <br />the system as long as the rate schedule remains reasonable <br />and non-discrimina~ory, and subject to approval by the state. <br /> <br />Page 2 of 5 pages <br />
