<br />I <br />I. <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />~, tJ#, <br /> <br />BYLAWS OF CHIPPERFIELD LANE DITCH <br /> <br />ARTICLE I - NAME OF ORGANIZATION <br /> <br />SECTION 1 - The name of the organization shall be <br />Chipperfield Lane Ditch Incorporated. <br /> <br />SECTION 2 - Location and service area is: <br />A. LEGAL: The land is located in the SW 1/4 of <br />section 26, the SE 1/4 ~I section 27, the NE 1/4 of section <br />34 and the NW 1/4 of section 35 all in T 6 S, R 92 W, of the <br />6th P. M. <br /> <br />B. PHYSICAL: The location is about 5 miles south of <br />Silt, Colorado. This Ditch is located along the south side <br />of Garfield County Road 326. The land irrigated form this <br />system is located on both sides of the same county road and <br />east of Garfield County Road 331 going east for about 1 1/2 <br />mile. <br /> <br />ARTICLE II - PURPOSE <br /> <br />SECTION 1 - The purpose of this company shall be for the <br />management of the Ditch for the landowners whose properties <br />are irrigated with water from this ditch. <br /> <br />SECTION 2 - To manage, upgrade, maintain, repair, clean, and <br />when necessary reconstruct the ditch in the best interests <br />of all members. <br /> <br />ARTICLE III - MEMBERS <br /> <br />SECTION 1 - Members will be property owners, in good <br />standing, who own or lease water shares or own water rights <br />in the Chipperfield Lane Ditch and whose properties are <br />located within the lateral service area described in Article <br />I. <br /> <br />SECTION 2 - Share certificates will not be issued to <br />members. <br /> <br />SECTION 3 - Membership in the organization will be retracted <br />upon the sale of the property affected and membership can be <br />transferred to the new owner(s). Any indebtedness that is <br />still owed will be either paid off or transferred to the new <br />owner(s) . <br />
