<br />WHEREAS, authority exists in the law and Funds have been budgeted, appropriated and otherwise made
<br />available and a sufficient unencumbered balance thereof remains available for payment in Fund Number 400 B

<br />ABL Account Number'17621, Org. Unit 71-77-771,
<br />WHEREAS, n'quired approval. clearance and coordination has been accomplished from and with appropriate
<br />agencies: and
<br />
<br />WHEREAS, the State and the Contractor did on September 1, 1979,
<br />enter into a contract for State participation in the construction
<br />of the Parachute (Grand Valley) project for the benefit of the
<br />inhabitants of the Town of Parachute in Garfield County, which
<br />contract is attached hereto as Exhibit A and is hereby incorporated
<br />herein; and
<br />
<br />WHEREAS, the State and the Contractor did on February 15, 1982,
<br />enter into an amended contract for State participation in the
<br />Parachute (Grand Valley) project, which amended contract is
<br />attached hereto as Exhibit B and hereby incorporated herein~ and
<br />
<br />WHEREAS, the Town of Parachute in' a letter to the State has
<br />indicated .that it has difficulties in making its second payment
<br />according to the original contract, Exhibit A~ and
<br />
<br />WHEREAS, the Town of Parachute has agreed to make a reduced
<br />payment of Four Thousand Dollars ($4,000) for the second year of
<br />its repayment~ and
<br />
<br />WHEREAS, the Town of Parachute has agreed to repay the
<br />remaining amount owed to the State by increasing the remainder of
<br />its payments over the next thirty-eight (38) years.
<br />
<br />NOW THEREFORE, in consideration of the mutual and dependent
<br />covenants herein contained-, it is agreed by the parties hereto as
<br />follows:
<br />
<br />1. The terms and provisions of paragraphs A.9. and B.4. of
<br />that certain contract dated September 1, 1979, attached hereto as
<br />Exhibit A and incorporated herein by reference, and 9mended in that
<br />certain contract dated February 15, 1982 (Exhibit B), shall no
<br />longer be effective but are further amended to read as follows:
<br />
<br />A.9. To purchase from the State all of the State1s right,
<br />title, and interest in said project and any facilities thereof at a
<br />total purchase price of Four Hundred Thirty-Seven Thousand Three
<br />Hundred Twenty-Nine Dollars and Forty Cents {$437,329.40}, payable
<br />in the fOllowing manner:

<br />
<br />First installment shall be due and payable on February 1, 1983, and
<br />yearly thereafter until the entire principal sum shall have been
<br />paid. Said installment payments shall be made payable to the
<br />Colorado Water Conservation Board, payable at the offices of said
<br />board in Denver, Colorado.
