Amendment.) to the above ref erenced contract between the <br />Colorado Water Conservation Board, Department of Natural Resources <br />and the Town of parachute, I have been asked to give my opinion as <br />Town Attorney for the Town of Parachute as to certain matters <br />outlined in the request letter dated May 2, 1986, from Mr. M. C. <br />Ioannides, P. E. on behalf of the Colorado Water Conservation Board <br />to Mr. Ralph Freedman, former Town Administrator. In making this <br />opinion I have reviewed the proposed Amendment together with the <br />exhibits thereto and Resolution No. 86-2 dated 5-22-86 , <br />1986, authorizing the execution of the Amendment. It should be <br />noted that the Town of Parachute is a statutory municipality and as <br />such as no independent charter. <br /> <br />Based upon my review of the above referenced documents and my <br />familiarity with the ordinances, resolutions and procedures of the <br />Town of Parachute, my opinion as to the requested matters is as <br />follows: <br /> <br />1. The signature of Mayor Joseph David Beasley is that of the duly <br />elected Mayor of the Town of Parachute and the attest of Barbara <br />M. Duff is that of the duly appointed Clerk of the Town of <br />Parachute. <br /> <br />2. By virtue of Resolution No. 86-2 enacted on 5-22-86 , <br />the Mayor and Town Clerk of the Town of Parachute have been <br />authorized to execute the Amendment on behalf of the Town of <br />Parachute, and the Amendment has been validly approved by the <br />Board of Trustees of the Town of Parachute. <br /> <br />3. The Board of Trustees of the Town of Parachute has the authority <br />to enter into the Amendment without a vote of the residents of <br />
