Co 81635. <br />hereinafter referred 10 as the contractor, <br /> <br />WHEREAS, authority exists in lhe Law and Funds have been budgeted, appropriated and otherwise made <br />available and a sufficient unencumbered balance thereof remains available for payment in Fund Number _~. <br />G/L Account Number 5762X, Contract Encumbrance NUplber C15331~ and <br />ABL Account Number 17621, Org. Un1t 77-77-777, <br />WHEREAS, required appro...:!I, clearance and wordinatiun has been accomplished from and wilh ilppropriate <br />agencies: and <br /> <br />WHEREAS. the State and the Contractor did on September 1. <br />1979. enter into a contract for State participation in the <br />construction of the Parachute project: and <br /> <br />WHEREAS. the contract was amended on February 15. 1982. and <br />on June 1. 1984; and <br /> <br />WHEREAS. the Town of Parachute in a letter to the State <br />requested that their yearly payment be made during the month of <br />May from 1986 onwards; and <br /> <br />WHEREAS. the State approved such request in January. 1986. <br /> <br />NOW. THEREFORE. in consideration of the mutual and <br />dependent covenants hereby contained. it is agreed by the <br />parties hereto as follows: <br /> <br />1. The terms and provisions of paragraph A.9. of that certain <br />contract dated September 1. 1979 (EXhibit A), and as amended on <br />February 15. 1982 (EXhibit B). and as further amended on June <br />1. 1984 (EXhibit C). which exhibits A. B. and C are attached <br />hereto and incorporated herein by reference, shall no longer be <br />effective and are further amended to read as follows: <br /> <br />A.9. To purchase from the State all of the State's <br />right. title. and interest in said project and any <br />facilities thereof at a total purchase price of Four <br />Hundred Thirty-Seven Thousand Three Hundred Twenty-Nine <br />Dollars and Forty Cents ($437.329.40). payable in the <br />following manner: <br /> <br />First Year <br />Second Year <br />Third to Fortieth Year <br /> <br />$ 10.815.00 <br />4.000,00 <br />11,118.80 <br />$437,329.40 <br /> <br />The first, second. and third installments shall be due and <br />payable on February 1. 1983. and yearly thereafter through <br />the year 1985. All other installments shall be due and <br />payable on May 1, commencing in the year 1986 and yearly <br />thereafter until the entire principal sum shall have been <br />paid. Said installment payments shall be made payable to <br />the Colorado Water Conservation Board. payable at the <br />offices of said board in Denver. Colorado. <br /> <br />2.
