WHEREAS, authority exists in the law and Funds have been budgeted, appropriated and otherwise made
available and a sufficient unencumbeted balance thereof remains a~i~ble for payment in Fund Number 4008

ABL Account Number 13187, Org. Unit 77-77-777, .
WHEREAS. re4uirl'd approv,,!. clearance and coordinatiun has been accomplished from and with appropriate
agencies: and

WHEREAS. purSUant to the provisions of 3/-60-119. Colorado
Revised Statutes. the State is authorized to loan money for the
construction of water projects for the benefit of the people.of
the State; and

WHEREAS. purSUant to Senate Bill No. 67, the Fifty-Second
General Assembly Of the State of .Colorado authorized the State
to loan a sum not to exceed One Million Two Hundred Thousand
Dollars ($1.200.000) to the Contractor for. the Contractor1s use
in performing c~rtain repair work on its irrigation system.
which work is referred to hereinafter as lithe project..: and

WHEREAS, the Qontractor has performed the project in
phases, and has previously completed five phases of the
project. for whic~ phases the State has loaned the Contractor
to date Nine Hundred Fifty-Five Thousand Dollars ($955,000), of
which amount the Qontractor has expended to date Nine Hundred
Twenty-Seven Thou~and Three Hundred Thirty-Three Dollars
($927.333); and

WHEREAS. Two ~undred Seventy-Two Thousand six Hundred
Sixty-Seven Dollars ($272,667) remains unspent from the
oriqinal $1,200,000 appropriation. and said $272.667 is
available to be l~aned to the Contractor for completion of the
sixth phase of th~ project: and

WHEREAS. Senate Bill No. 67 provided that the amount
authorized for lOqns of this type could be increased by such
amounts as are jU~tified by reason of ordinary fluctuations in
construction cost~ as indicated by engineering cost indices
applicable to thi~ type of work; and

WHEREAS. purs~ant to Senate Bill No. 67, the state has
determined that t4e amount available to be loaned for the total
project should be increased by Five Hundred Ninety-Seven
Thousand Six Hundred Twenty-Three Dollars ($597,623). to a
total of One Million Seven Hundred Ninety-Seven Thousand six
Hundred TWenty-Three Dollars ($1.797,623). and of the
additional $597,6~3 required, the sum of Twenty-Seven Thousand
Three Hundred Thirty-Three Dollars ($27.333). as well as the
$272.667 remaining from the original appropriated amount. is
available to be loaned for completion of the sixth phase of the
project: and

WHEREAS. the State has now agreed to loan the Contractor
Three Hundred Tho~sand Dollars ($300.0DO) for completion of the
sixth phase of the project. the total cost of which phase will
be six Hundred Thousand Dollars ($600.000);
