<br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />Description of the Preferred Alternative <br /> <br />/ <br /> <br />Preisser, the project sponsor, has selected the alternative to establish an augmentation plan based <br /> <br />on the purchase of certain Box Springs water rights in conjunction with a cash settlement <br /> <br />agreement with Smith, Reid, and the HCWUA. <br /> <br />The specifics of the plan are in the Settlement Agreement included as an attachment to this <br />report. Briefly, the plan can be summarized as follows. <br /> <br />Under the terms of the settlement agreement between Box Springs, Smith, and Reid, Preisser <br />may relocate-the six wells within the boundaries of his property, as long as no more than two <br />wells are located west of the centerline of Section 21, T14S, R58W, 6th PM. The settlement <br />agreement allows the water pumped from the wells to be used for any beneficial use included in <br />the original decree. <br /> <br />The augmentation source for the project is a 2 cfs portion of a 60 cfs water right decreed to Box <br />Springs Canal No. I, with an appropriation date of October 24, 1899 and an adjudication date of <br />August 30, 1922. This is a feasible source of augmentation water, because the annual amounts to <br />be diverted and consumed by the Preisser wells are less than the amounts consumed under the <br />Preisser 2 cfs portion of the Box Springs water right. In addition, the intervening senior water <br />users (Smith and Reid) have stipulated to the adequacy of the Box Springs right to augment <br />Preisser's depletions. <br /> <br />CWCB funds from the Small Project Loan account in the amount $90,000 are sought by Mr. <br />Preisser under this project for partial funding for the purchase of the Box Springs Canal No. I <br />augmentation water and for partial compensation of intervening seniors. The remainder of the <br />funds for the water rights purchase, and to effect the settlement between Preisser and Smith, <br />Reid, and the HCWUA to protect Preisser's rights against their senior call, will be provided <br />partially by Preisser's own funds and partially from proceeds of his sale of land and water rights <br /> <br />HRS WATER CONSULTANTS, INC. <br /> <br />page 8 <br />
