13.c. Collection costs. If the principal or accrued interest under this contract is not paid when due, the <br />CONTRACTOR agrees to pay all reasonable costs of collection, including reasonable attomey fees. 'In the <br />event of any bankruptcy or similar proceedings, costs of collection shall include all costs and attorney fees <br />incurred in connection with such proceedings, including the fees of counsel for attendance at meetings of <br />creditors' committees or other committees. <br />b. Paragraph I, page 9 is changed to read as follows: <br />L Upon complete repayment to the STATE of the entire principal and any accrued interest as specified in the <br />Promissory Note Provisions of this contract, the STATE agrees to execute a release of deed of trust to <br />convey to the CONTRACTOR all of the STATE's right, title, and interest in and to the property described in <br />Paragraph A.14, and to execute a UCC-3 form to terminate all of the STATE's rights in and to the revenues <br />pledged to repay this loan. <br />C. Paragraph M, page 10 is amended by the addition of the following: <br />M. To reflect the adjusted loan amount, the Contractor shall execute an Amended Security Agreement, <br />attached as Attachment 1 and incorporated herein. Furthermore, the Contractor acknowledges that the <br />State shall perfect its security interest by filing a UCC Form with the Colorado Secretary of State. <br />4. The effective date of this Amendment is the date first written above. <br />5. Except for the SPECIAL PROVISIONS, in the event of any conflict, inconsistency, variance, or contradiction <br />between the provisions of this Amendment and any of the provisions of the ORIGINAL CONTRACT, the <br />provisions of this Amendment shall in all respects supersede, govern, and control. The SPECIAL PROVISIONS <br />shall always be controlling over other provisions in the contract or amendments. The representations in the <br />SPECIAL PROVISIONS concerning the absence of bribery or corrupt influences and personal interest of STATE <br />employees are presently reaffirmed. <br />6. Financial obligations of the state payable after the current fiscal year are contingent upon funds for that <br />purpose being appropriated, budgeted, and otherwise made available. <br />7.
