<br />WHEREAS. pursuant to the provisi.ons of section 37-60-119,
<br />Colorado Revised Statutes, as amended, the State is authorized
<br />to construct certain water projects for the benefit of tile
<br />people of the State of Colorado; and
<br />
<br />WHEREAS, the Farmers Water Development Company has made
<br />application to the State for the improvement of its existing
<br />facility, such improvement of the facility is llereinafter
<br />sometimes referred to as the project; and
<br />
<br />WHEREAS. the Contractor is a water development company
<br />within the State of colorado;
<br />
<br />NOW THEREFORE, it is hereby agreed that:
<br />
<br />1. The Contractor shall have a feasibility report prepared
<br />and directed to the problem of improving the facility of the
<br />contractor (Gurley Reservoir) in accordance with a proposal for
<br />a project feasibility report prepared by the conSUlting
<br />engineering firm of Steffen Robertson and Kirsten (the
<br />Consultant) and approved by the State, received February 10.
<br />1987, which proposal is attached hereto as Exhibit A and made a
<br />part of this contract.
<br />
<br />2. Fifteen (15) copies of the final report called for in
<br />this contract shell be furnished to the State not later than
<br />May 30, 1987. unless such time is extended by mutual agreement
<br />of the parties hereto in writing.
<br />
<br />3. As compensation for the services of the Contractor, the
<br />State shall pay to the Contractor the sum of SiKty Thousand
<br />Dollars ($60,000) in the manner following:
<br />
<br />a. Sixty percent (60%), to wit, Thirty-.Six Thousand Dollars
<br />($36.000) of the total amount due in two (2) monthly
<br />installments of Eighteen Thousand Dollars ($18.000) each.
<br />commencing on March 1, 1987.
<br />
<br />b. The remaining fotty percent (40%), to wit. Twenty-Four
<br />Thousand Dollars ($24,000) within forty (10) days following
<br />receipt and acceptance of the written report specified in
<br />paragraph 2. of this contract.
<br />
<br />4. The total cost of services to be rsnde[ed [or the
<br />Contractor by the Consultant is Eighty-Five Thousand Dollars
<br />($85,000) and t~e Contractor shall pay the sum of Twenty-Five
<br />Thousand Dollars ($25,000), and in no event shall this payment
<br />be the liability of the State of Colorado.
