<br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />CHAPTER II <br /> <br />DURANGO WEST METRO DISTRICTS NO. 1 AND NO. 2 <br /> <br />The Durango West Water Supply Project is jointly sponsored <br />by Durango West Metropolitan District's No.1 and No.2. The <br />District's were formed to provide: (1) a network of streets, <br />drives, and boulevards, (2) a complete water supply, treatment, <br />storage, transmission, and distribution system, and (3) a <br />complete sanitary sewage collection, transmission, treatment, <br />and disposal system. The facilities to serve approximately 620 <br />units were installed with the original bonding, as described for <br />each district. Figure II-l shows the boundaries of each <br />District. <br /> <br />Both Districts were established under the laws of the State <br />of COlorado, particularly Title 32, Article 1, Part 10, and <br />particularly section 1004 thereof, C.R.S. 1973, as amended. The <br />Districts have the power, among others, to enter into contracts <br />and agreements, to sue and be sued, to incur indebtedness and <br />issue bonds, to refund any bonded indebtedness of the Districts <br />without an election, to fix rates, fees, tolls, or charges for <br />services or facilities furnished by the Districts, to pass and <br />enforce regulations promulgated by the Boards, to compel <br />structures to be connected to the Districts' water and sewer <br />facilities for the protection of public health when lines are <br />within 400 feet of such structures, to levy and collect general <br />ad valorem taxes, to acquire, dispose of and encumber real and <br />personal property, to have the management, control, and <br />supervision of all the business affairs of the Districts, and <br />the construction, installation, operation, and maintenance of <br />improvements therein, and to exercise the power of eminent <br />domain and dominant eminent domain for the condemnation of <br />private property for public use, except for the acquisition of <br />water rights. <br /> <br />DISTRICT NO. 1 <br /> <br />District No.1 is located on the south side of U. S. Highway <br />160 and includes an area of 112 acres. There are currently 135 <br />homes in the District with a maximum number of platted units of <br />225. This District was formed to provide medium priced homes by <br />allowing mobile homes and modular units, as well as the typical <br />frame homes. The homes within District No. 1 are generally <br />priced below $100,000.00, and are all individual homes with no <br />multiple family units. The lots for each home are relatively <br />(to District No.2) small, so the potential for lawns is also <br />small. <br /> <br />There has not been a new unit constructed in District No. 1 <br />in the last three years, because the developer who owns the <br />undeveloped lots is in bankruptcy.
