BACKGROUND AND PURPOSE. The Bureau of Reclamation (Reclamation) <br />has been requested by the Colorado Water Conservation Board (CWCB), on behalf <br />of a group of local entities, to conduct a re-evaluation study of the Owens <br />Creek Reservoir Project (Study) under the Technical Assistance to the States <br />Program. The local entities are the Battlement Mesa Water Conservancy <br />District (Battlement Mesa), the West Divide Water conservancy District (West <br />Divide), the Ute Water Conservancy District (Ute) and the Colorado River Water <br />Conservation District (River District). The purpose of the Study is to <br />determine the quantity and reliability of water storage and estimate <br />construction costs for the proposed Owens Creek Reservoir Project on Buzzard <br />Creek, originally decreed in Case No. W-821-76, Water Division 5. Beneficial <br />uses of the project water would be domestic, supplemental irrigation, <br />recreation, and potentially fish and wildlife via releases for the endangered <br />fish in the IS-Mile Reach of the Colorado River. <br />{ <br />2. PARTICIPATION BY RECLAMATION. Reclamation's Upper Colorado <br />Regional Office will provide S30,OOO or 50 per cent of the funding required to <br />accomplish the Study activities identified in the attached Scope of Work, <br />hereinafter referred to as Exhibit A. A majority of the work identified in <br />Exhibit A will be performed by Reclamation's Denver Office under a service <br />agreement with the Upper Colorado Regional Office. <br /> <br />3. PARTICIPATION BY THE SPONSORS. The Sponsors, which include the <br />CWCB and the local entities, will provide S30,OOO or 50 per cent of the <br />funding (cash and in-kind services) required to accomplish the Study <br />activities identified in Exhibit A. In-kind services will consist of the <br />installation of a gaging station, quantification of project water demands, and <br />coordination activities. <br /> <br />4. SCHEDULE. All Study activities identified in Exhibit A under <br />Phase I will be completed, and a summary memorandum will be delivered to each <br />of the Sponsors at their respective addresses identified in Section 10 of this <br />Memorandum of Understanding (MOU) , by September 30, 1992. However, <br />accomplishment of this schedule by Reclamation is contingent upon receipt of <br />in-kind work products and coordination of activities by the Sponsors, in a <br />timely manner. <br /> <br />5. FUNDING AND PAYMENTS. The total estimated cost asqociated with <br />accomplishing the Study activities (Phases I & II) identified in Exhibit A is <br />$60,000. It is the intent of all parties to this MOU that $30,000 or 50 per <br />cent of the cost associated with accomplishing the work identified in Exhibit <br />A be borne by Reclamation and S30,OOO or 50 per cent borne by the Sponsors. <br />The Sponsors' contributions shall be a combination of cash and in-kind <br />services as further defined in this MOU. Each Sponsor shall provide a check <br />for its cash contribution within 30 calendar days of the execution of this <br />MOU, made payable to Reclamation, and delivered to the address for payments <br />identified in Section 10 of this MOU, with the exception of the CWCB, for <br />which $4,000 shall be payable within 30 calendar days and S4,OOO at the <br />initiation of Phase II Study activities. <br /> <br />I <br />
