WHEREAS, rCIlllircd approv'al, clearance and coordination has been accomplished from and with appropriate
agencies; lind'

WHEREAS, 'J pursuant to the provisions of 37-60-119. colorado
Revised statutes 1973. as amended, the Colorado Water Conservation
Board is authorized to construct certain water projects for the
benefit of the people of the state of Colorado; and

WHEREAS, the Town of Eagle has made application to the. Colorado
Water conservation Board for the construction of a wate~ project
for the purpose of improving its municipal water supply; and

WHEREAS. the contractor is a professional engineering firm
within the State of Colorado and has previously done considerable
water-related work for the Town of Eagle and various other
municipalities in Colorado;

NOW THEREFORE, it is hereby agreed that

1. The Contractor agrees to prepare a feasibility report
directed to the problem of improving the domestic water supply for
the Town of Eagle in accordance with a proposal for project feasi-
bility report prepared by the Contractor and approved by the
Colorado Water Conservation Board, dated August 7. 1975, which
proposal is attached hereto as Appendix A and made a part of this
contract.
2. Thirty (30) copies of the report called for in this
contract shall be furnished to the State not later than December 1,
1975, unless such ~ime is extended by mutual agreement of the parties
hereto.
3. As compensation for the services of the Contractor. the
state agrees to pay the contractor the sum of Two Thousand Eig~t
Hundred ($2,800) in the manner. following:

a. Sixty percent (60%), to wit, One Thousand Six Hundred
Eighty Dollars ($1,680) of the total amount due in two monthly
installments of Eight Hundred Forty Dollars ($840) each, commencing
on October 1, 1975.
b. The remaining forty percent (40%), to wit, One
Thousand One Hundred Twenty Dollars ($1,120) Dollars within thirty
(30) days following receipt and acceptance of the written report
speci fied in paragraph 2 of this contract.

4. This contract is personal in nature and assignment of
performance by the Contractor to another is prohibited unless prior
approval in writing is granted by the State.
