<br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />RULES AND REGULATIONS <br />OF <br />THE HIGHLAND DITCH COMPANY <br /> <br />ARTICLE I <br /> <br />INTRODUCTION <br /> <br />1,1 AUTHORITY <br /> <br />These rules and regulations are adopted by the Board of Trustees ("Trustees") of <br />the Highland Ditch Company ("Company"). These rules and regulations applied only to <br />the Highland Ditch Company and do not include the laterals which receive Highland Ditch <br />water. It is the responsibility of the Company's employees to deliver water to the main <br />headgates of laterals. Each lateral is responsible for rules and regulations regarding <br />delivery of water beyond the main headgate, <br /> <br />1,2 CONFLICT <br /> <br />Any Conflict between these rules and regulations and the Articles of Incorporation <br />or the By-Laws of the Company shall be resolved in favor of the Articles of Incorporation <br />or the By-Laws, <br /> <br />ARTICLE II <br /> <br />WATER RIGHTS AND ASSETS OF THE COMPANY <br /> <br />2,1 The Company owns direct flow water rights as follows: (1) a November 30, <br />1871 priority for 205.46 cubic feet per second (cfs); (2) a June 1, 1878 priority for 23,57 <br />cfs; and (3) a September 20, 1902 priority for 95 cfs, The amount of water that the ditch <br />is entitled to is measured in cfs, or how many cubic feet of water will pass a given spot in <br />one seCond, The number of cfs when doubled, converts to acre feet (aJ,) or the amount <br />of water needed to cover one acre of ground one foot deep with water, The number of <br />acre feet divided by 20 equals the number of inches. <br /> <br />2,2 The Company owns Highland Reservoir #1, Highland Reservoir #2, Highland <br />Reservoir #3, Foothills Reservoir, Mcintosh Reservoir, 49% of Beaver Park Reservoir and <br />associated ditches, canals and other improvements. The use of the water in the reservoirs <br />(not including surface rights) and ditch belongs exclusively to the shareholders, <br /> <br />1 <br />
